The research on theory of Work Safety Law (WSL) is relatively insufficient and there exist many deficiencies in the law and that results in an unfavourable effect in the prevention of work accidents and occupational hazards. It concludes through logical deduction, text analyzing, empirical and comparative studies that: WSL should be categorized to social law with the purpose of protecting the OSH rights and interests of employees. The regulating scope should include all employers and the self-employed. Four principles should be followed as its guiding ideology, namely, Principle of Life-first and Employees-priority, Principle of Stressing Prevention and Combining Prevention with Controlling, Principle of Multi-parties’ Participation and Condominium, and Principle of Science and Technology. To check WSL now in force, it is found that it is imposed with improper purposes, function and regulating scope, and the concrete provisions are far from perfect with altogether88pieces defects. Under the direction of the above theoretical conclusions, a personal amendment including more than150piece of revising advices for WSL is put forward with some of the important ones discussed in detail, for example, professional qualification system, legal interference on employers’ internal work safety management, workers’ right to participation of work safety decision-making, the WS promotion of NGO and social service agencies, the work safety regulation system, WS obligation system and so on.
