The popularity of electronic products has brought not only much convenience to people's work and life, but also a lot of e-waste. E-waste has the characteristic of both pollution and resources. From the environmental protection point of view:e-waste has more pollution than the average municipal solid waste, because the toxic substance it contains stays longer and can't easily be cleared. It will do more harm to the surrounding ecological environment and human health. If we solve the problem from legal point of view, we can make the pollution caused by electronic waste under effective control. From the perspective of resource recycling: electronic waste which contains many precious metals, once it is discarded directly and it will cause a great waste of resources. Perfect the disposal and recycling of e-waste laws is not only suit for the development strategy of recycling economy of our country, but also fit for the target of constructing conservation-minded society and the global strategy of sustainable development. Although we have much e-waste related legislation, many important systems remains to be established. It is very necessary to study the legal system of the disposal and recycling of e-waste in China.The paper is generally following the idea of "raise problem-analyze problem-solve problem" to find the wonderful way to construct the laws of the disposal and recycling of e-waste that fit for our country.First, the article introduced the concept of "e-waste" to define the primary meaning and marked feature.The same time, analysis the situation of the disposal and recycling of e-waste in our country and find the reasons for the situation. Second, we introduced the legislation of foreign countries about e-waste in order to find something that useful for our country. Finally, contact our current status of e-waste recycling disposal status of legislation, put forward the perfect proposal of the legislation of the disposal and recycling of e-waste:"two points and one line and one coordination". The "two points" means the disposal of worthless e-waste and the recycling of some valuable e-waste; "One line" is related to the subjects which run through the management of the disposal and recycling of e-waste. "one coordination" means the coordination among the subject of e-waste related duties, obligations and rights.
