Study On The Role Of Government To Perform Their Duties In Doctor-patient Conflicts

Where there are medical practice, it is possible that medical malpractice exists, and no country can avoid the situation objectively. Doctor-patient conflict is the product of health care reform, and is the integrated product of negative social factors. In recent years, with the social transformation and economic transition and health system being reformed into depth, the medical market is boosting step by step, the doctor-patient conflict has taken place and has been intensified around the country. The doctor-patient conflict sometimes turns into the mass-incidents and violent cases. In contemporary, some people let off steam by colliding with the hospital."Hired hospital violator"has become a profession. And it has become the main consciousness that it is profitable to cause some trouble in hospital. The conflicts has seriously violated the legitimate rights and interests of the doctors, and has an impact on the normal hospital treatment order, and wasted the scarce medical resources. On the other side, the conflicts is against the vital interests of public. Therefore, the interests of both doctors and patients are compromised. At present,the conflicts have become a serious problem affecting the social stability.From the perspective of public-management, the social phenomenon is mainly due to the reasons because that both patients and hostitals are the greatest self-interests seekers . In the course of pursuing their interests, the clash is inevitably. Government is the major"provider"for public goods, and the"helmsman"of the social development, and the"makeup"for market failure. Government plays the role in the prevention and disposal of doctor-patient conflicts, mainly in the public decision-making, legislation enforcement, macro-control, industry regulation, and social stability maintenance. All above, the government plays an essential role in the prevention and disposal of the doctor-patient conflicts. However, the power of the government exists the border, and the efficiency of the government is limited, and the government failure is difficult to be completely avoided. Therefore, the energy of the government is limited in the prevention and disposal of the doctor-patient conflict.Despite the substantial public resources has been input into the prevention and disposal of conflicts, and our government is also trying its best to perform their duties. However, the traditional concept of public administration and backward modes of social control can not fully adapt to the new situation of social development. It has to be admitted, the doctor-patient conflicts directly exposed many deficiencies in social management, some main examples are"the third type of error"in the public decision-making, absence of government, offside of government, inefficient to perform their duties, and so on. It is required that the government has to improve the functions of the public management, such as, to prevent the"third type of error", to play a reasonable role in their duties, to build credibility of the government, to improve the functions of the public services.In the paper, according to the performance of the doctor-patient conflict, basing on the theory of government functions, trying to analyze the social causes of conflict, to clear the responsibility of the government, to find the staus and the lack of the government. Finally, some proposals of the government reform are recommended.It is expected that the government is going to further improve and strenthen the public administrative mechanism, to promote government reform, to rebuild the idea of the government governance, to try to meet what the pulic is requring. It is also expected that the government will combine the"visible hand"and the market"invisible hand"on the correct location, perform the duties reasonablly. By improving the functions of the government, the government will play the important role in the prevention and disposal of the doctor-patient conflicts.
