| At present, with China's entry into the World Trade Organization and the expansion of exchange to the outside world, legal activities have become more frequent in China. In the meantime, legal translation studies have, too, become more important than ever before. Legal translation can bridge Western countries and China with proper communication, which plays an active role in economic development.The goal of legal translation lies in promoting international exchanges, maintaining the order of international trade, and advancing the world economic development. Simultaneously a high-quality version of legal translation is in urgent. However, legal translation is an interdisciplinary subject that involves legal science, linguistics and translatology, and the study of legal translation is dispersed in some periodicals and monographs. It is still in its preliminary stage, the theoretical construction of legal translation needs to be improved further.Legal language includes legislative language, judicial language and language of legal enactment. Judicial language includes the courtroom language and language of the decision, which can be said to be one of the most vigorous and richest languages. Judicial language is also the hot spot in legal translation.Meanwhile, audiovisual translation has become a special research area, which has not been obviously observed in academic circles. But in the field of cross cultural exchanges, rapid achievement has been made in audiovisual translation studies. However, legal translation of audiovisual works apparently rare in periodicals and monographs.The present dissertation focuses on the principles and strategies of legal translation that is based on audiovisual works, combining judicial language with popular media—movies. The present dissertation tentatively deals with some principles of translation, and triple principles are suggested, that is, the principle of accuracy, the principle of legalese, and the principle of legal culture. Compared with the universally mentioned principles of literary translation (the principle of faithfulness, the principle of expressiveness, and the principle of elegance), these three principles can better meet the need of legal translation.The present dissertation is divided into six chapters. Chapter one briefly introduces the origin and development of legal language and legal translation, and the relationship between legal translation and translation of legal science. Chapter two dips into legal translation in audiovisual works, as well as the characteristics of audiovisual translation. Chapter three elaborates the factors of translatability and translatability of legal language. Chapter four expounds the principles of legal translation. Chapter five discusses strategies employ in legal translation, translator had better give priority to the foreignization, and balance the foreignization and the domestication; in terms of techniques, translator had better employ some approaches (transliteration, coinage, and legal interpretation) in legal translation so as to realize the dynamic equivalent. Chapter six summarizes the great significance and the future prospect in legal translation. |
