The labor-capital relation is one of the most basic relations of our human society.Because the benefit differences within these two parties are so opposite as well ascooperative, the settlement of their dispute is both necessary and inevitable. With theinfluences of economy system, social structure, culture and politics, the absence of labordispute settlement system will lead to all kinds of unstable social problems, which shouldbe paid more attention to. Sometimes, it's difficult for the two parties to solve the disputeby themselves. The interference of a neutral or the government as the third party is veryimportant to resolve the dispute. With the development of socialist market economy andthe deepening of business reform in our country since 1990s, labor dispute occursfrequently. Improving and reforming system of settlement of the labor dispute becomesnecessary.This essay is in the context of settlement of the labor dispute in China .It analyzes thebasic status and current condition of settlement of the labor dispute. With introduction anddiscussion on several oversea systems of the labor dispute settlement in western countries,it brings up new ideas and feasible suggestions about the reform and development of ourChinese dispute settlement system. It takes aim at perfecting the system in order to providea harmonic and stable atmosphere to our economic society.This essay is divided into four parts. The first chapter instructs the relevantconception of settlement of the labor dispute and analyzes its history ofdevelopment .The second chapter analyzes the problem existed by researching the basicsystem and its contribution to history. The third chapter brings up some ideas used forreference .The forth chapter brings up the ideas and suggestions of reforming anddeveloping a new system of settlement of the labor dispute in China particularly.
