As the senior level education of higher education, not only has great significance to the individual and the society, but also to the core competitiveness of the country.However, the present situation of higher education in China is not so satisfactory, the education resources and opportunities in urban and rural areas is very uneven between regions, class, nation and individual distribution, and the imperfect laws, the lack of relief procedure, make the function of higher education can not fully play, also do not conform to the constitutional principle of equality, stripped by the educators in higher education admission opportunity equality, increasing phenomenon of the college entrance examination immigrant, worsening the allocation of resources, will eventually hinder the talent flow, impede the process of harmonious society. Therefore both law and policy, should formulate certain rules, balance the allocation of education resources, to ensure the equal opportunity, and also should perfect the procedure of corresponding judicial, promote the long-term development of economy and society, and improve the international competitiveness of the country.This thesis is mainly divided into six parts. The first part is the introduction, mainly on the simple review. The second part of the higher education opportunity equality of some concepts involved are analyzed, starting from the connotation of the right to education, extending to the connotation of the right to education in the field of higher education, and also analyzed the essence of equality, the equality is the real equality, is to allow a reasonable difference, laying a theoretical foundation as discussed below. The third part is the present situation of the higher education opportunity inequality, has carried on the analysis from the urban and rural, regional, ethnic, class, individual etc.. The fourth part analyzes the causes hindering factors of higher education inequality situation, both legal and procedural, and uneven allocation policy. The fifth part is also the key part of the higher education opportunity equality, in front of the obstacles, and puts forward some ideas from the legislative, judicial, law enforcement aspect. The legislation focuses on making admissions test, ensure the recruitment fair and open. Judicial relief, through the improvement of existing models, equal rights to better protect citizens which is the access to higher education.
