Migrant Worker Migration Legal Issues

Along with the transformation from traditional agricultural society to modern industrial society,the farmer worker community have emerged naturally. They keep pace with market trends that bring the effect of labor force resources configuration into play. With the background of awaiting breakthrough in dual economic structure of urban and rural areas, the peasant workers have found a new job floating way making overall plans for urban and rural employment as well as labor market,there is a problem of scarcity of an important human right,this human right is the right to move about freely.Strictly speaking,the right to move about freely is not a new right,but because of the social and historical reasons,this right has been out of the system of human rights protection for a long time.Because of the reasonsabove,the study on the right to move about freely looks more important.The right to move about freely can be comprehend as that in the range of the constitution and the range of the law,a citizen has the right of personal freedom and action freedom,it also contains the freedom of changing living place on the premise of the same right guarantee with the citizens of the ingoing place.It contains two part,one is the freedom to move about,the other is the correlation treatments in the course of movement. The core of this paper is to probe free rights of farmer workers movement, at the same time, attention should be paid to equal status. The thesis starts from the general theories of farmer workers'emigration and discusses the most outstanding three questions: labor employment, peasant laborer children compulsory education questions, and especially female farmer workers'gender equality. Through the analysis of the current situation and the reasons, the system of peasant workers'free movements should be constructed from the angle of citizenship.It is necessary to solve the legal problems of farmer workers migration well, protect their freedom of movement and related rights, construct graceful environment to fit their development, raise their integral quality, and increase the proactiveness and initiative in the construction of city modernization. It is not only related to seek a breakthrough on the issues of agriculture, farmer and rural area, but also promote industrialization and urbanization healthy and orderly, even concerned with justice, harmony and stability, as well as new rural communities construction.
