This article established a model of institutional transition, on the base of the North's institutional transition theory. In our special background, the changing process of the protection of rights and interests of peasant-workers as follow: With the reforming of the economic system, the household registration system and labor and employment system, peasant-workers have the possibility to get the proceeds out of the existing system. Driving under"the logic of survival",play the role of"primary action groups"under the"state of unconscious". It's the starting of the demand institutional transition. At the same time, because of their own rights and interests are not being protected,an ambiguous demand to change the existing system is come up. However, as the unique legitimacy of the supply institutional transition from the Government and the inherent flaw of demand institutional transition in the formal arrangements, when the peasants press on the government directly, they have to influence the city if they want the Government to act as a"secondary action groups". After overcoming some obstacles, even on the basis of cost-benefit analysis, the Government will put the new arrangements info practice.
