On Perfection Of The Government Price Hearing System Of Our Country

As a control method of the macroeconomic regulation, the government price controls are the necessary means and useful supplement in China's current market economy development. Because most of the government pricing products and services are public welfare or monopoly, the government price controls are related to the people's livelihood. The hearing procedures are introduced in the process of government pricing, whose significance is not only that it established a kind of brand-new mechanism that is participated mainly by government price departments, monopoly industries and consumers. The three parties are mutual influenced and restricted to seek the harmonious win-win pattern and price forming mechanism, what's more, it builds a political participation platform for the social public, which has a profound significance in the reform of public decision system, the construction of democracy and the rule of law as well as the construction of harmonious society .In general, the government pricing hearing system in our country is initially groped and then gradually specified and finally persistently expanded. However, as well as the great achievements, there are many problems. On the one hand, academic circles think that pricing hearings take on a good outlook; on the other hand, government pricing hearing system suffer lots of setbacks in its implementation and practice.This thesis mainly analyzes many problems in the goal orientation, scoping, procedural rules and validity of the government price hearing system by citing the examples of the water price hearings in recent years in big cities. It holds that we must eliminate the misunderstanding, find out target localization and clarify the functions and responsibilities. We must recognize that the public interest is a composite category, including public interests as a consumer and reasonable interests as an enterprise,both of the two should be effectively safeguarded; we should look at price hikes in a dialectical way ,it must be acknowledged that "inappropriate" side of profit or the "conspiracy" between the enterprise and the government can lead to price hikes, the other side that cannot be ruled out is the objective economic law and the sustainable development strategy; For the moment, pricing hearings can not totally become the price decision making meetings, a series of targets such as democracy and science, fairness and efficiency, freedom and order need to be weighted reasonably and considered comprehensively. The effective improvement of the government pricing hearings should be based on the correct orientation, and the definition of the scope, the selection of the hearing subjects and the judgment of the effectiveness of the records in price hearings and the hearing procedures should be further optimized in order to form a triangle checks and balances of the price government price departments, business practice and consumer groups. The final perfection of the government pricing hearing system also depends on the institutional environment optimization, so we should adhere to market-orientation and promote reform of the administrative system. On the basis of straightening the relationship between government and enterprises, the reform in the privatization of the monopoly and the reform of the management system must be actively developed through deepening price and gradually relaxing government price controls; we should strive to build civil rights society under the orientation of the civil rights. On the basis of straightening out the relationship between the government and the public, the organizational carrier, ideological support and practical platform for the construction of the civil society must be provided by increasing the social public and the subject consciousness, increasing the cultivation of social organizations and strengthening the construction of electronic government efforts for civil society, justice orientation should be uphold and the legal protection must be strengthened. Through the strengthening legislation and law enforcement and resorting to the judicial, a good legal environment must be molded for the benign development of price hearing system of our country.
