Bt Mode Government Guarantee Law Studies

BT (build-transfer) mode, adopted widely in non-profit infrastructure projects, has solved the fund shortage problem of the local government and accelerated the urbanization process. However, due to the flaws in legislation, theory and system, many problems have emerged during the practice of the BT mode, government guarantee being one of them. Full amount payment purchasing on schedule is the key to BT projects. With its uniqueness and necessity taken in consideration, government guarantee under the BT mode should not be treated as ordinary government guarantee or guarantee measures of government under the BOT mode. As a result, how to deal with government guarantee under this mode, whether the practical patterns are lawful and reasonable, whether there are any rules and regulations facilitating its improvement, and so forth, all these become significant subjects for research.This thesis consists of the following aspects in addition to the preamble and the conclusion:Firstly, it introduces briefly government guarantee under the BT mode, focuses on its origin, necessity, importance and present risks, and then provides essential background information for legislation.Secondly, it clarifies the legal nature of government guarantee under the BT mode, makes a comparison between government guarantee under the BT mode, guarantee measures of government under the BOT mode and ordinary government guarantee. This will pave the way for conducting in-depth clarification of government guarantee under the BT mode.Furthermore, it studies the domestic situation of government guarantee under the BT mode, analyses rationally specific means of operating government guarantee or government safeguards under the BT mode, discusses the advantages and disadvantages, and reveals the existing legal problems.Finally, from a legal point of view, this thesis puts forward suggestions concerning the improvement of government guarantee under the BT mode, including solidifying the foundation of the system and other solutions can be explored.
