Purpose: In the recent years, China’s economy has growing steadily, while in thedevelopment of state-owned enterprises and private enterprises, a number of foreigncompanies have entered the Chinese market and followed by various enterprisesproduction factory. Due to the particularity of the industry and the different productionprocess, some industries in the production that would be effect on workers’ health, inwhich the more serious harm is occupational hazards arising from the process. China isone of the countries affected more serious by occupational hazard. Although there arelaws to make provisions on the occupational disease prevention, but in the governmentsupervision and enterprise self-discipline and laborer own rights aspects which are stillsome problems to be solved latter.In Jilin province, the importance of the automotive industry is obvious, not only asa pillar industry but also has formed a large-scale industrial chain, and promote otherappropriate industry to flourish. This article aims to occupational hazards of weldingoperations in Changchun automobile industry have an investigation, know about thegovernment control of occupational diseases, the executive condition of the carmanufacturer for the "The People’s Republic of China Occupational DiseasePrevention Law" and the implementation of the relevant laws and rules, as well asenterprises in the prevention of occupational diseases to protect the health of workers,the workers affected by occupational hazards and to investigate wether these workersknow their own rights, such as the right to information, occupational health right, theright to damages as well as the right to refuse dangerous work. And will be analyzedaccording to the results of these investigations and ultimately to find an effective wayto protect workers’ health and safe.Method: The study used a literature analysis, interviews, case analysis andquestionnaires. Used random sampling and cluster sampling method, and inChangchun select three administrative region of automobile manufacturing companiesin work of the welding job to have questionnaire. After data entry, statistical analysisusing Spss13.0, at the same time, I have interviewed to the investigators that include occupational regulatory authorities and occupational disease prevention departments aswell as have careful analysis the corresponding cases of occupational hazards.Results: Through surveys and interviews the results obtained as follows: In the right toinformation, the workers who have less education, engaged in automotive welding jobhave a lare proportion and they understand the situation of occupational diseasessignificantly lower than higher education. They are age small, narrow range ofknowledge and so on that lead to have a less occupational disease related knowledge aswell as enterprise publicity is also poor. In occupational safety and health rights, theenterprise need to be improved to provide protective equipments for workers andunfrequently organize workers to have regular occupational health examination. Due tothe different enterprise property, the private enterprise obviously worse thanstate-owned enterprises and joint ventures. In the rights to damage, due to the laborerswho have a short of “Occupational Disease Prevention Law” and related legalawareness of our country and they are still in a weak position, do not know how to uselegal rules to claim their legitimate rights and interests, resulting these laborers rare touse these rights to protect themselves. In the right to refuse dangerous work, our"Occupational Disease Prevention Law" clearly provides that when companies have notfulfill this obligations, the workers could refuse the job and the companies shouldaccept unconditionally. However, in fact, the workers as individuals has been restrictedby enterprises, the majority of people choose to abstain to exercise this right.Conclusion: Through the analysis can be seen, the laborer’s right to know protectioncondition overall is good, most companies can be inform what kind of occupationalhazard factors would be happen during the operation, but in the past in theoccupational health of workers training needs to be strengthened, some companiesnever organize training at all. Because of the long period incidence of electric welderpneumoconiosis and welding workers has greatly mobility, as a whole industry ofoccupational disease incidence is less, so in terms of the right to damages of the overallsituation is better. But in occupational safety and health of workers rights and the rightto respect of damage should be further protected.
