The Study On The Means Of Protecting Farmers’ Ecological Rights And Interests

The concept of ecological rights and interests was put forward for the first time after the 18 th National Congress of the Communist Party of China.Ecological rights and interests are not only an important part of human rights,including economic,political,cultural,and social rights and interests,but also an essential condition for realizing human’s overall development.People’s living and development are inseparable from the natural environment.Farmers are those who have a more significant impact on the society development,and their rights of overall development cannot be ignored.However,due to the destruction of rural ecological environment,the ultimate habitat where farmers rely on is suffering from the invasion,and farmers’ rights of living and development have faced enormous challenges.In addition,farmers are a less privileged group on the protection of various rights and interests.Thus,it is of practical significance to encourage and support the studies on farmers’ ecological rights and interests.This thesis first introduces the concept of ecological rights and interests,and puts it in the context of the special group of farmers.The author details these aspects and puts forward a clear concept of ‘what are the ecological rights and interests for farmers’.The study analyzes the present situation of farmers’ living environment,the lack of implementation of their ecological rights and interests and the resulting dangers.The author concludes that the current situation can be looked at from four different perspectives.(1)An inappropriate administration system has led to an urban and rural dual social structure.There are subjective contradictions in government regulation,no implementation of the ecological protection,and one-sided pursuit of economic development.(2)From a legal point of view,there is an imperfect legislation for the protection of farmers’ ecological rights and interests.The enforcement of the laws is not strong enough.Shortcomings of judicial protection also exist.(3)From an economic point of view.There are serious environmental pollution problems about township enterprises.Pollution transfer between urban and rural areas.Farmer’s development notion may be out-of-date.(4)From a social point of view,farmers’ awareness of the existence of laws in general is low.And some manufacturing companies are responsible for the pollution they produce but try to evade any fines or punishment.These are some constraints leading to the lack of the protection of farmers’ ecological rights and interests.Farmers need to fully understand ‘why to protect the ecological rights of farmers’.Based on the above discussed factors,the author proposes some strategies to protect farmers’ ecological rights and interests from four different aspects,including systemic,legal,economic,and social aspects.Then suggestions are followed on ‘how to protect farmers’ ecological rights and interests’.
