The Legal Protection Study Of Ecological Rights And Interests Of Forest Farmers

With increasing attention to human rights and the construction of ecological civilization,due attention should be given to the ecological rights and interests of forest farmers.Human beings experienced a deeper understanding of nature during the period of pre-industrial revolution,industrial revolution,and post-industrial revolution.The development of ecological rights and interests experienced a change from narrow anthropocentrism to ecological centralism,and finally to the ethics of sustainable development.In China,the term“Ecological rights and interests” was proposed and applied in academic circles mainly after the18 th CPC National Congress.Ecological rights and interests are a basic human right and should be protected by law.Ecological rights and interests are a basic human right and should be protected by law.The idea of "harmony between man and nature",the theory of a community of shared future for mankind,and the theory of sustainable development provide the theoretical basis for ecological rights and interests.This article analyzes the connotation of ecological rights and interests from the changing process of the relationship between man and nature,determines the content of ecological rights and interests,and explores the current status of forest farmers’ ecological rights and interests,and discovers that forest farmers’ ecological environment to enjoy rights,ecological resource use rights,ecological protection compensation rights,environmental conditions,information rights,environmental affairs participation rights,and relief claims are all damaged to varying degrees.Therefore,from the aspects of inadequate legislation,incomplete construction of the modern forestry property rights system,incomplete forestry ecological compensation mechanism,impediments to the realization of the environmental right to information,relatively narrow access to environmental issues,and difficulty in realizing judicial remedies,this article analyzes the barriers to implementation.On this basis,it proposes the path to realize the ecological rights and interests of forest farmers,respectively improved from the aspects of legislation,rural environmental law enforcement,modern forestry property rights system,forestry ecological compensation mechanism,environmental right to know,environmental things participation rights,and judicial relief approaches,in order to promote the construction of ecological civilization,and effectively safeguard the ecological rights and interests of forest farmers.
