In 2017 launched the national carbon emissions trading market,by 2020 and strive to build a complete system,active trading,strict supervision,open and transparent national carbon emissions trading market,realize the stable,healthy and sustainable development.It shows the world the determination of China to implement the Paris accord as the largest emitter of carbon and the second largest economy.However,we can not ignore the fact that China's carbon emissions trading research than the EU,the United States and other developed countries started late,of course,this is both a disadvantage and advantage.On the one hand,China's legislation to deal with climate change and carbon emissions trading is not complete,and is in the process of starting the national carbon emissions trading market and it will be necessary to fill in the relevant legislation.On the other hand,we can learn from the already established perfect carbon emissions trading market of the European Union,the United States and other countries experience,the same as the reference of developing countries in India,established its own carbon emissions trading legal system experience.Take the essence,to its dregs,combined with China's basic national conditions,the development of legal system can guide the establishment of a national carbon emissions trading market unified china.This paper focuses on the basic of the international carbon emissions trading,learn from the experience of European Union,the United States and the India current carbon emissions trading legal system,and summarizes the development experience since the establishment of China's provinces and cities in carbon emissions trading pilot,and provide advice in the aspect of legal system for the establishment of a national carbon emissions trading market unified China.
