The Study Of The System Of Relative And Centralize Forestry Administrative Punishment Power

The system of relative and centralize forestry administrative punishment power is the important contents of the reform of forestry law enforcement system,which concentrates law enforcement power of multiple agencies to one department in forestry system,which is the deepening and expanding of the the system of relative and centralize administrative punishment power in forestry law enforcement,which is the important system innovation of protecting forest resources.In 2014,Yunnan firstly implemented the system of relative and centralize forestry administrative punishment power on Forest Public Security.This model gives full play to the role of forest public security,which can solve the problem of duplicate law enforcement step by step,can improve the efficiency and quality of law enforcement,can realize the better effect of law enforcement,can strengthen the management and protection of forest resources.In this article,taking Yunnan province as an example,the author discusses the relative centralized forestry administrative penalty system in four parts.In the first part,the author starts from the basic concept of the relatively centralized forestry administrative penalty system and discusses the development process and development model of the relatively centralized forestry administrative penalty system.The second part,by investigating the implementation of the relatively centralized forestry administrative penalty system in Yunnan Province,discusses the main contents,background and course of development,and analyzes the legitimacy of power sources,the qualifications of law enforcement subjects,the scope of authority and the procedures.The results are demonstrated from two aspects:the promotion of the whole province and the innovation measures of individual prefectures.The third part,from the current laws and regulations system,the law enforcement force,the law enforcement guarantee mechanism three aspects of the problems in the implementation of this system,and analysis of reasons.The fourth part,from the establishment of a sound legal and regulatory system,strengthen the main force of law enforcement,establish a law enforcement guarantee mechanism,strengthen law enforcement supervision and other aspects of countermeasures,for the implementation of relatively centralized forestry administrative penalty system put forward reasonable and feasible suggestions.
