Dispute Resolution In New Rural Society

As a practical research topic,the settlement of local disputes is mainly carried out in the fields of jurisprudence,sociology of law and legal anthropology.Over the years,a considerable amount of research work has been done and thus produced lots of scholarly achievements.However,since the reform and opening up,China's rural society has undergone structural changes,transforming from the traditional "rural society" into "new rural society",and its dispute settlement way has also changed.Starting from the classical theoretical model of "Rural China",this paper analyses the nature and governance mechanism of traditional Chinese rural society and the action logic of Chinese peasants under this background,which can provide a reference for exploring the path of resolving disputes in new rural society.On the basis of the existing theory of local dispute settlement,it is necessary to study the village dispute settlement through the approach of contextualism.It is necessary to face up to the practice and understand the real situation of the dispute settlement in the specific village social context.Based on the field investigation of Tongcun village in central Hubei,this paper first introduces the basic situation of the case village from three perspectives,and then describes the basic types and characteristics of village disputes as well as the specific process of dispute resolution,taking the development of specific dispute resolution events in the village as a clue.It also analyses the action logic of the parties and the settlers engaged in the process of dispute settlement,trying to reveal the practice forms of dispute settlement in the new rural society.Using the theories and methods of sociology to study the specific social scene of village dispute resolution,it attempts to find out the structural factors affecting the operation of village dispute resolution mechanism,and explore the tight connection between the practice of dispute resolution and the village interpersonal relationship,the village endogenous authority and the state power.
