The Optimization Of The Dispute Settlement Mechanism Of Post-rural Society From The Perspective Of Legal Sociology

With the downward penetration of the state power and the influence of the market economy,the rural society is undergoing structural changes,gradually changing from the traditional vernacular society to the post vernacular society.The rural social contradictions and disputes in the change of social structure are becoming more and more complicated.A new form has emerged,and the means of dispute resolution are becoming more and more diversified.Dispute resolution is the core content of rural governance.Discussing the dispute resolution mechanism of rural society has important practical significance for stabilizing rural society and realizing rural revitalization.Through practical investigation,a village in the east of Fujian Province was used as the investigation point to discover the process of dispute resolution in the post-native society from specific dispute cases,and then analyze the specific role played by the third-party subjects and effect in various types of dispute resolution in dispute resolution.Then,starting with the authority behind dispute resolution,we discuss the rise and fall of authority involved in dispute resolution and the dilemmas faced by various authorities.From this,it was found that various kinds of authority came out one by one in different historical periods,and occupied a dominant position in different historical periods.The post-native society showed a situation of multiple authorities,divisions,and mutual games in dispute resolution.These authorities still have these problems in dispute resolution: The native endogenous authority is gradually lost,the secondary endogenous authority is declining,and rural society is gradually compatible with the exogenous authority,but the exogenous authority cannot fully replace the endogenous authority due to its own limitations.These problems prevent many disputes in rural society from being properly resolved,and thus become the main factor affecting the stability of grassroots society.In order to reduce rural social disputes and achieve long-term stability in rural society,suggestions for optimizing dispute resolution mechanisms are proposed.The overall idea is to take secondary-type endogenous authority as the core.By enhancing its main position and giving corresponding governance rights,it becomes a rural society.New stabilization mechanism.In addition,we must pay attention to the system guarantee role of exogenous authority,and minimize the impact of the limitation of exogenous authority on dispute resolution through the remodeling of exogenous authority and the repositioning of functions.Of course,villages in post-native societies still retain many traditions.For disputes involving traditions,the role of native endogenous authority should be taken seriously.
