Research On Legal Mechanism Of Energy Cooperation Between China And Russia

2019 is the 70 th anniversary of the establishment of diplomatic relations between China and Russia.China and Russia are in a new stage of comprehensive strategic partnership.Studying the legal mechanism of energy cooperation is of great strategic significance for promoting and deepening China-Russia energy and even economic and trade cooperation,and consolidating friendly exchanges between the two sides.This article first introduces the current state of cooperation between China and Russia in the traditional oil and gas energy fields,as well as in the fields of power and nuclear power.Under the advantages of mutual political trust,complementary energy structures,and geographical proximity,the two countries will develop energy cooperation in the future bright future.Then,from the domestic legislation of the two countries,agreements in the field of bilateral cooperation,regional cooperation agreements,and dispute settlement mechanisms,this article details the current legal framework of energy cooperation between the two countries and the existing defects in the current legal framework.Thirdly,the author selected the legal mechanism of energy cooperation between China and the United States,and energy cooperation legal events of the European Union and the Energy Charter as the practical experience to improve the bilateral cooperation level,regional cooperation level,and specialized energy cooperation organization level.And learn from it the solution to the current energy cooperation between China and Russia.Subsequently,guided by basic principles,the framework of the legal mechanism was constructed from three aspects: organizational framework,hierarchical structure,and content framework.The China-Russia Energy Cooperation Committee was expanded under the framework of regular meetings between the Prime Minister;Law,bilateral agreements,multilateral（regional）treaties,and global energy international cooperation are the four levels of coordination of energy laws and regulations.Finally,the content of the legal system of China-Russia energy cooperation should include the basic agreement on energy cooperation,the system of energy overseas investment and trade protection,the energy emergency reserve mechanism,the energy information sharing system,and the energy cooperation dispute settlement system.
