Research On China’s National Parks’ Legal System

National Park,as a generally accepted mode of nature reserve for the protection of natural resources and ecological environment in the international community,can better control natural resources,protect biodiversity and maintain the sustainable development of ecosystem.On September 27,2017,the general office of the CPC Central C ommittee and the general office of the State Council jointly issued the overall plan for the establishment of the national park system,which clearly proposed to build a unified,standardized and efficient national park system with Chinese characteristics,and to establish a scientific classification and strong protection of the natural reserve system.Up to now,great progress has been made in the overall construction of China’s national parks,but there are still many deficiencies in the establishment and improvement of the legal system.National Park,as a new type of protection mode,has many comprehensive functions such as scientific research,education and recreation while protecting the authenticity and integrity of the natural ecosystem.In the process of the construction and development of its legal system,it will inevitably conflict with other natural protection real estate students in China.How to deal with the application and connection of laws and regulations and establish A scientific and efficient management system and a practical and operable concrete system are the key to improve the legal system of national parks in China.Under the background of the reform of ecological civilization system in China,it is very important to study the legal system of national parks in the world and establish and develop the legal system of national parks with Chinese characteristics in combination with China’s national conditions.This paper analyzes the basic problems in the construction of the legal system of national parks in China,and summarizes the experience of the construction of the representative legal system of national parks in the international community.Through the formulation of the basic law and the improvement of the relevant legislation,the scientific planning of national parks,the establishment of a unified management organization,the improvement of the public participation system,the franchise system and the ecological compensation system,etc,In order to provide legal protection for the construction of national park system.
