Research On The Legal System Of National Parks

A good ecological environment is not only a natural wealth,but also an economic wealth,which is related to the potential and stamina of economic and social development.In 1872,the United States on the other side of the ocean built the world’s first national park,achieving a dynamic balance between the effective protection and rational development of natural resources,setting a world precedent.Countries have followed suit and established more than 140 national parks.Today,national parks have become the most common type of nature reserves in the international community.However,national parks are still in their infancy in our country.On October 12,2021,with the approval of relevant state departments,my country officially established the first batch of national parks including Sanjiangyuan,Giant Panda,Siberian Tiger and Leopard,Hainan Tropical Rainforest,Wuyi Mountain,etc.with a protected area of more than 200,000 square kilometers,covering nearly one-third of the land area under national key protected wild animal and plant species.It fully embodies the practice of Xi Jinping’s ecological civilization thought,and has played a milestone significance for my country to explore and establish a system of natural reserves dominated by national parks.At present,the construction of my country’s national park system is in a state of steady progress,with remarkable achievements in stages,and various systems have accumulated experience and achieved world-renowned results.However,Our country always has the question to protect the national parks.The main reasons are that the national park legislative system is not perfect,the specific legal system is not perfect,the management system is not clear,and the supporting mechanism is not perfect.Improving the legal system of national parks can better protect rare and endangered wild animals and plants.Developed countries and regions have attached great importance to the establishment of national parks for many years,accumulated rich experience in the field of national park-related legislation,and formed a relatively mature theoretical system for the construction of the legal system of national parks.My country should learn from the beneficial experience of the legal system of national parks in developed countries outside the region,and combine with the actual situation of our country to improve the legal system of national parks from the aspects of improving the legislative system of national parks and improving the related systems of national parks.The specific measures mainly include: improving the legislative system of national parks and formulating a special "National Park Law";improving specific legal systems such as national park access standards,natural resource property rights system,franchise system,and ecological compensation system;improving the national park management system,Including clarifying the setting of management institutions,clarifying the division of management functions and powers,and establishing a coordinated management mechanism between the central and local governments;optimizing the multi-fund raising mechanism for national parks,improving the volunteer service mechanism,and improving the public participation system and other supporting mechanisms for national parks.
