Research On The Legal System Construction Of National Nature Reserve

The 19th National Congress of the Communist Party of our country clearly stated that national parks should be vigorously constructed as the main body of the protected area system.However,there are many problems in the construction of national parks in China.One is the lack of a basic national park law.The problem of separate local legislation has led to the lack of a unified legal basis for the management of national parks in our country,and there are practical problems such as overlapping functions among management agencies;the second is that there is no systematic management system.The establishment of the National Park Service in 2018 marked the official establishment of the top leadership of the national park.However,the allocation and management of central and local management rights have not been clearly planned,resulting in difficulty in coordination and cooperation between management departments and low management efficiency;The third is that the basic system for the construction of national parks is not sound.No relevant laws have been formulated to adjust the issues related to capital investment and public participation in the construction of national parks,and there are gaps in the basic system.In this regard,my country can summarize and learn from the rich experience and achievements of the United States and Japan in the formulation and management of national park laws,so as to accelerate the establishment of a national park legal system and management system in line with my country’s national conditions.In the construction of the legal system,the concept of sustainable development and a community of life should be established first,which is consistent with the core of the national park;secondly,the relationship between national parks and other nature reserves should be straightened out,in order to clarify the unique status and importance of national parks.On the basis of value,formulate a special law,and integrate and link the existing laws and regulations related to nature reserves and national park pilots,and improve the national park legal system;and in the specific practice of building national parks,a complete management system and specific system It is the key to ensure the smooth progress of practice.In summary,studying the construction direction and specific measures of national parks in my country is of far-reaching significance for better protection of natural resources and ecological environment,and the comprehensive values contained in national parks will also provide humans with a better ecological environment and life quality.
