Study On Legislation Of Ecological Compensation In National Parks

The establishment of a natural protected area system with national parks as the main body is an important part of ecological civilization system construction in the new era of China.Since 2016,China has successively set up ten national park pilot projects.On this basis,it is proposed to establish and improve the ecological compensation mechanism in various fields,especially to improve the ecological compensation policy for national parks,and form the most stringent protection for China’s national parks from the legislative level.Therefore,as a national park system is an important content in building,national park,ecological compensation legislation requires not only the existing ecological compensation on the basis of the practice of local legislation,we will continue to improve the development needs to build more high-level adapt to China’s basic national conditions,national park,ecological compensation legislation with Chinese characteristics,gradually formed to national park ecological compensation legislation as the main body,the local legislation for added complete scientific system effective ecological compensation legal system.In this paper,using the method of literature research,comparative research,analyzes the problems existing in the ecological compensation legislation,and by using the principle of the law and combining the practical situation to analyze its reasons,in learning from countries outside the park ecological compensation legal results and preliminary results were obtained in pilot practice in our country,on the basis of ecological compensation legislation Suggestions to our country national park.The main contents of this paper are as follows:The introduction part mainly elaborates the research background and theoretical significance of national park ecological compensation legislation,as well as the review and analysis of the current research trends at home and abroad.The first part,starting from the stakeholder theory,regional development balance theory and ecological justice theory,carries on the analysis,which lays the theoretical groundwork for the research of national park ecological compensation legislation.The second part,from the existing national park ecological compensation local regulations on the legislative status of the comprehensive analysis.In the third part,the author mainly analyzes the status quo of the legal system of ecological compensation in three foreign national parks,and summarizes and extracts their advanced experience.The fourth part,according to the existing problems in the national park ecological compensation legislation,puts forward the corresponding improvement ideas,and provides suggestions for the comprehensive legislation of national park ecological compensation in China.
