A Study On The System Of Ecological Environmental Damage Compensation

In order to implement the legal system of consultation on compensation for ecological environment damage,give full play to its functions,and realize the polluter paying and the infringer taking responsibility,we should scientifically construct the legal system of consultation on compensation for ecological environment damage。 The scientific construction of the consultation legal system of ecological environment damage compensation is also conducive to reducing the cost of liability for ecological environment damage,improving the efficiency of ecological restoration and ecological compensation,and achieving the unity of economic and social benefits。 This paper consists of four parts。 The first part expounds the theoretical basis of the legal system of consultation on compensation for ecological environment damage,including the related concepts similar to the legal system of consultation on compensation for ecological environment damage,the definition of the legal nature of the system and the theoretical basis applicable in China。 The second part analyzes the current situation of legislation and practice of the legal system of consultation on compensation for ecological environment damage in China,and analyzes the shortcomings of the legal system of consultation based on the current situation。 Generally speaking,the scope of consultation subject is narrow,the procedure of consultation is not perfect,the content of consultation is not clear,and the way of consultation relief is not perfect。 The third part is to learn from the experience of relevant legal systems of foreign countries or regions,and select the legal systems of the United States,Japan and the European Union。 The fourth part is to provide four suggestions for the scientific construction of the legal system of ecological environment damage compensation consultation,which are : first,expand the main scope of consultation;second,improve the consultation procedure;third,clarify the contents of consultation;fourth,improve the way of consultation relief。...
