On The Allocation Of Central And Local Powers In The Early Warning Of Public Health Emergencies

With the advent of risky society,public health emergencies occur from time to time,and early warning,as an important part of risk prevention,has become more and more prominent.The early warning system for public health emergencies in my country has been tested in the 2019 new crown pneumonia epidemic,and the allocation of early warning power to the central and local governments is in urgent need of reflection and improvement.The current early warning power has problems such as too high levels,unclear division of central jurisdictions,inability to adapt to the requirements of the proper principle of power allocation,and the social foundation not being taken seriously,which has led to the low efficiency of the early warning system in my country.Based on the main problems of the central government’s power allocation in the early warning of public health emergencies,this article attempts to use hermeneutics under the current legislation framework of the public health emergencies early warning system.On the basis of sorting out,we will try to perfect the allocation of early warning power for central and local governments.First,the “territorial management” is explained,and it is concluded that governments at or above the county level should have early warning powers,and through the principle of hierarchical responsibility,the corresponding levels of early warning powers of governments at all levels should be clarified to give full play to the initiative of local governments;The disease control agency is included in the main body of early warning,stipulates that it enjoys independent medical early warning rights,and highlights the professionalism in risk management.Third,strengthen the government’s information disclosure before the early warning of public health emergencies,introduce the whistleblower system,and then strengthen the supervision of the society,and better realize the benign interaction between the government and the society.Finally,carry out the legislative work of the Law on Response to Public Health Emergencies,clearly stipulate the corresponding early warning powers of the central and local governments,and build an early warning system with multiple early warning subjects,reasonable power allocation and sensitive emergency response in my country.Preventing risks is an inescapable constitutional obligation of the country.Giving full play to the enthusiasm of both the central and local governments in the early warning of public health emergencies will help shape a legal system that better realizes this obligation,and use this as an opportunity to further improve the country.Vertical governance capabilities and governance levels.
