Since the end of 2019,the Newcastle pneumonia epidemic has been raging around the world and has become a gloom over the public’s head.And in the context of economic globalisation,with the development of international transport and international travel,the epidemic is spreading faster and more widely,posing a challenge to global public health governance.The current international public health governance system is centred on the World Health Organisation(WHO),supported by regional health governance systems,and is mainly based on the International Health Regulations(2005)and the domestic health systems of each country,of which the determination of PHEIC is one of the key issues.The main basis for determining whether a health event constitutes a PHEIC is the relevant provisions of the International Health Regulations(2005).The International Health Regulations(2005)set out in detail the criteria,procedures and rights and obligations of each State Party,which appear to be clear and unambiguous,but in practice there are drawbacks.In practice,there are drawbacks.There are many shortcomings in the implementation of the IHR(2005).In terms of the accreditation process,the PHEIC accreditation process lacks authority.The World Health Organisation(WHO),as the core of global health governance,has a limited coordination and leadership role and is unable to effectively unite all sovereign states to actively respond to international public health events through concerted international cooperation and assistance.Moreover,the legality of additional health measures taken by countries in response to PHEIC and the boundaries of their application are still controversial and often exceed the limits of reasonableness and appropriateness,leading to international disputes.Therefore,in order to improve the international legal regime and system related to PHEIC in a timely manner,legislation at the level of international legal responsibility should be promoted by establishing a timely and efficient regional information sharing mechanism,bringing into play the international coordination and field role of the World Health Organization,improving the response mechanism for public health emergencies of international concern;regulating the understanding and application of additional health measures,and establishing a mechanism for remedying the failure of temporary recommendations;and To establish a system of assistance and cooperation that is compatible with practice,to promote horizontal supervision and cooperation between countries,or a system of cooperation to combat epidemics in various ways,and to uphold the concept of a community of human destiny,and to work together to explore and improve certain existing systems and rules in the field of international public health governance at the level of international law,so as to ensure that humanity can safely overcome public health crises.
