The water pollution in the Yangtze River Basin has the characteristics of mobility,complexity and cross-regionality,which determines the need to control water pollution from the source.As the key area of source control,the upper reaches of the Yangtze River Economic Zone is an important pass to prevent and control water pollution in the Yangtze River Basin as a whole,which is helpful to promote the sustainable development of water ecological environment in the Yangtze River Basin.In order to explore the way of inter-provincial joint prevention and control to control water pollution in the upper reaches of the Yangtze River Economic Zone,and to achieve the goal of unified and coordinated water pollution control in the whole Yangtze River Economic Belt.Through empirical analysis,comparative analysis at home and abroad,and literature analysis,the existing problems of the legal mechanism of inter-provincial water pollution joint prevention and control in the upper reaches of the Yangtze River Economic Zone are discussed from the following aspects.Specifically :The first chapter expounds the related concepts of the legal mechanism of inter-provincial water pollution joint prevention and control in the upper reaches of the Yangtze River Economic Zone.It clarifies that sustainable development theory,holistic governance theory,collaborative governance theory and external diseconomy theory are the theoretical basis and basic theory of the legal mechanism of inter-provincial water pollution joint prevention and control in the upper reaches of the Yangtze River Economic Zone,and analyzes the feasibility of this mechanism.The second chapter mainly analyzes the current situation and dilemma of the legal mechanism of inter-provincial water pollution joint prevention and control in the upper reaches of the Yangtze River Economic Zone.From the current situation of legislation,China ’s relevant policy documents and laws and regulations provide normative guidance for the legal mechanism of inter-provincial water pollution joint prevention and control in the upper reaches of the Yangtze River Economic Zone from the macro level.From the current situation of practice,the joint prevention and control of water pollution in the region is mainly promoted by signing cooperation agreements,carrying out inter-provincial consultation and cooperation joint meetings in the upper reaches of the Yangtze River,and promoting public participation.However,there are still some problems,including the imperfect legislative coordination mechanism of inter-provincial water pollution joint prevention and control,the imperfect main mechanism of joint prevention and control,the unclear basis of inter-provincial cross-regional joint law enforcement,and the lack of supporting guarantee mechanism for inter-provincial judicial cooperation.The third chapter sorts out the legal mechanism of inter-provincial joint prevention and control of water pollution in the Beijing-Tianjin-Hebei and Yangtze River Delta regions,and finds that the Beijing-Tianjin-Hebei region regulates inter-provincial joint prevention and control of water pollution through collaborative legislation.The implementation of joint prevention and control measures is guaranteed by signing cooperation agreements,establishing a water pollution prevention and control coordination group in the Beijing-Tianjin-Hebei region,and promoting joint law enforcement and judicial cooperation in the region.The Yangtze River Delta region has carried out joint prevention and control of sudden water pollution incidents by signing cooperation agreements.The joint law enforcement and judicial cooperation mechanisms in the region have provided experience for the improvement of the inter-provincial water pollution joint prevention and control legal mechanism in the upper reaches of the Yangtze River Economic Zone.The fourth chapter puts forward suggestions for improving the legal mechanism of inter-provincial water pollution joint prevention and control in the upper reaches of the Yangtze River Economic Zone.First,improve the coordination mechanism of inter-provincial water pollution legislation in the upper reaches of the Yangtze River Economic Zone by promoting inter-provincial water pollution joint prevention and control coordination legislation in the upper reaches of the Yangtze River Economic Zone,improving the normative system of cooperation agreements,and improving public participation mechanisms;the second is to improve the inter-provincial water pollution joint prevention and control mechanism in the upper reaches of the Yangtze River Economic Zone by standardizing the inter-provincial joint meeting system,establishing inter-provincial coordination and deliberation institutions in the upper reaches of the Yangtze River Economic Zone,and improving the accountability mechanism.Third,through legislation to regulate the main content of joint law enforcement,strengthen inter-provincial joint law enforcement cooperation,promote inter-provincial joint law enforcement supervision and improve inter-provincial cross-regional joint law enforcement in the upper reaches of the Yangtze River Economic Zone;the fourth is to strengthen the inter-provincial cross-regional judicial cooperation support by improving the legal guarantee mechanism of judicial cooperation and expanding the information sharing channels of judicial cooperation.
