Research On The Coordination Mechanism Of River Basin Environmental Administrative Law Enforcemen

The spillover and public nature of environmental pollution in watersheds make collaborative management a basic idea of environmental management in watersheds.The legislation of the Yangtze River Protection Law(announced on December 26,2020)and the Yellow River Protection Law(announced on October 30,2022),two watershed laws in quick succession,has opened the curtain of watershed environmental protection.Administrative enforcement of watershed environmental laws is a key component of the effective implementation of watershed laws.The current administrative enforcement of watershed environmental laws,which is mainly based on regional management,is far from the large integrated and integrated enforcement required by watershed environmental governance,and the reform costs of a unified enforcement program for watershed management agencies are too high.Therefore,a more feasible option at this time is to strengthen the synergy between existing basin environmental administrative enforcement authorities to address the holistic nature required by basin environmental governance.The shift in the spatial perspective of basin rule of law brings new connotations to basin environmental administrative law enforcement,and it is necessary to conduct a new jurisprudential analysis of basin environmental administrative law enforcement.The types of practice of collaborative basin environmental administrative law enforcement are divided into cooperative administrative law enforcement and inspector-type administrative law enforcement.The principle of administrative integration and the administrative coordination mechanism are the administrative law basis of administrative law enforcement cooperation in the basin.From the perspective of administrative law,the analysis framework of "organization-proceduretechnology" is used to take a holographic view of the basin’s environmental administrative law enforcement coordination mechanism and seek the future optimization direction of the basin’s environmental administrative law enforcement coordination mechanism.At the organizational level,there are dilemmas such as the poor operation of grassroots administrative law enforcement,insufficient social coordination,unclear distribution of responsibilities for administrative law enforcement coordination,and lack of supervision of administrative law enforcement coordination.At the procedural level,there are different standards of administrative law enforcement,poor connection between administrative law enforcement and justice,and a single way to resolve disputes in administrative law enforcement coordination.At the technical level,there are dilemmas such as uneven monitoring planning and construction,the insufficient guarantee of administrative law enforcement equipment,and poor information sharing of administrative law enforcement.The organizational mechanism of basin environmental administrative law enforcement synergy should improve the administrative law enforcement entrustment mechanism,administrative law enforcement responsibility mechanism,administrative law enforcement participation mechanism,and administrative law enforcement supervision mechanism.The procedural mechanism of basin environmental administrative law enforcement should unify the basin environmental administrative law enforcement standards,improve the basin environmental administrative law enforcement and judicial interface procedures,and build a multi-dimensional dispute resolution mechanism for basin environmental administrative law enforcement coordination.The technical mechanism of basin environmental administrative law enforcement should strengthen the planning and construction of the monitoring system,improve the security level of administrative law enforcement equipment,and build an administrative law enforcement information-sharing platform.Chinese modernization is a modernization in which people and nature live together in harmony.The construction of a modern environmental governance system cannot be achieved without a coordinated and efficient environmental administrative enforcement system.The implementation of watershed laws needs to be based on a coordinated and efficient environmental administrative enforcement system.The construction of a coordinated and efficient watershed environmental administrative enforcement system is of great significance to the construction of a beautiful China.
