Research On The Optimized Path Of Internet Medical Mutual Aid Regulation From The Perspective Of Responsive Regulation Theory

Internet medical mutual aid inherits the mutual aid spirit of "watching each other and helping each other" in Chinese traditional culture,and uses the information matching function of the Internet to build a new form of medical security based on the stranger community,which makes up the deficiencies in the level of assurance and coverage of the traditional medical security system.It becomes a supplement to our country’s multi-level medical security system.After ten years of development,while the Internet medical mutual aid industry gradually grows,many problems also expose.Negative news such as "refusal of compensation" and "arbitrary shutdown" exposes continuously.It not only disrupts the industry order,violates the rights and interests of platform members,but also harms social harmony and stability.In recent years,the voices from all walks of life to strengthen the regulation of Internet medical mutual aid never ceases.However,the nature of Internet medical mutual aid is complex,the industry changes rapidly,and the regulation is difficult.At present,the regulation of Internet medical mutual aid lags behind the development of the industry.The regulation of Internet medical mutual aid also attracts the attention of the academic community.Many scholars discuss the regulatory attribution and the regulatory necessity of Internet medical mutual aid.However,the existing research on the regulation of Internet medical mutual aid mainly focus on government departments,and a complete theoretical system is not formed.In view of this,based on the perspective of responsive regulation theory,this paper uses literature research method,case analysis method and interview method.On the basis of researching the existing relevant literature,this paper selects several typical events with great social influence in the field of Internet medical mutual aid for analysis.Combined with the interviews of government department staff,practitioners and members of Internet medical mutual aid platforms,the problems and causes of Internet medical mutual aid regulation are analyzed from the three dimensions of regulatory institutions,regulatory subjects and regulatory means.The research finds that there are the following problems in the regulation of Internet medical mutual aid: the regulatory practice of Internet medical mutual aid is lack of institutional guarantee;the rights and responsibilities of the regulatory subjects of all parties are blurred;and it is difficult for traditional regulation means to cope with the characteristics of the new industry of Internet medical mutual aid.The main reasons are: the laws and ordinances on the Internet medical mutual aid regulation lag behind the development of the industry;a coordinated and interactive regulatory system of diversified subjects is not formed;and it is lack of innovation and efficiency in regulatory means.In response to the above problems,this paper proposes optimized paths for the regulation of Internet medical mutual aid.At the level of regulatory institution,the regulatory institution system for Internet medical mutual aid should be established and improved to ensure that the regulation practice has laws to abide by.At the level of regulatory subjects,in order to form a diversified and coordinated regulatory pattern,the government regulation department should be clearly defined,the industry association should be established,the self-regulation awareness of the platforms should be strengthened,and the enthusiasm of the platforms and the industry association to participate in regulation should be mobilized.At the level of regulatory means,intelligent and differentiated regulatory means should be adopted,mandatory and encouraging regulatory means should be used,attention should be paid to innovative regulation means,and technological means should be used to promote efficient regulation.
