Research On The Withdrawal Mechanism Of Representative Inheritors Of Intangible Cultural Heritage

At present,the management of representative inheritors of intangible cultural heritage in China has changed from extensive declaration and identification to scientific and dynamic management.There are gradually withdrawal cases of canceling the qualification of representative inheritors in China.However,compared with the huge four level representative inheritors system,these withdrawal practices are a small part after all,and there is still a lack of legal research on the withdrawal mechanism of representative inheritors.In view of this,by combing the legislative provisions and law enforcement practices on the withdrawal mechanism of representative inheritors at the national and local levels,this paper summarizes the legal status of the withdrawal mechanism,and finds that there are mainly problems such as non-standard application of the withdrawal mechanism,unclear relevant procedures,lack of legal relief measures,etc.the main reasons for these problems are that the basic theory of the withdrawal mechanism is unclear,the legislative provisions are vague Lack of the concept of due process and imperfect supervision system.In this regard,this paper suggests that we can clarify the meaning of representative inheritors,improve relevant legislative provisions,refine withdrawal and supervision procedures,distinguish different withdrawal types and take different measures to solve the current implementation dilemma of the withdrawal mechanism.
