Research On The Environmental Protection System Of Mining Right Transfer

Mineral resources are important materials on which human society relies for itsexistence and development. However, the exploitation of mineral resources adverselycauses ever-increasing environmental problems. The Third Plenum of the18thCPC Central Committee proposed to “establish a system of compensation for the useof natural resources and the subsequent impact on the ecosystem, and reform themanagement mechanism of environmental protection.” It is one of key measures forthe reform of management mechanism of environmental protection to strengthenenvironmental protection within the whole process of mining right transfer and buildperfect and efficient environmental protection system of mining right transfer.An effective environmental protection system is an integrated one. Theenvironmental protection system of our mining industry lacks integrity, control on theenvironmental protection at the origin is weak, and the supervision during the processis insufficient, all of which make it very necessary to impose environmentalprotection within the process of mining right transfer for overall planning andregulation. This paper, starting from the current status and problems of mining righttransfer of our country, conducts thorough research on the problems of environmentalprotection of mining right transfer, and points out that relevant system is in need ofimmediate improvement.This paper conducts thorough research on relevant theories of biological capital,environmental rights, game theory of balanced interests, sustainable development,green economy, and makes efforts to provide reference for the perfection ofenvironmental protection system of mining right transfer of our country by referringto the status and experiences of the environmental protection of the US and Australia.Dedicated to the weakness that control on the environmental protection of our miningindustry at the origin is not stringent and lack of numerical indicators for thesupervision on environmental protection, the paper puts forward an evaluation systemon the environmental protection by referring to circular economy evaluation systemand green mining evaluation system, which is supposed to be applied to the evaluation on transfer of mining rights and supervision on environmental protection, so that theenvironmental protection of mining industry is controlled and embodied at the originof mining right granting and is well supervised and implemented.Finally, the paper puts forward suggestion to implement the environmentalprotection system of mining right transfer of our country: to implement theenvironmental protection system shall focus on the environmental protection,strengthen coordination and perfection of system of mining right transfer andenvironmental protection, strengthen supervision on the protection of miningenvironment, strengthen financial and technical support at the system level, hoping toprovide valuable reference for future construction of environmental protection systemof mining right transfer.
