One is the far-reaching market reformation the former planned economy countries took in order to enter the global economy system base on planned economy. The other is the open-door economic strategy more and more developing countries took in order to reduce the state's intervention of domestic and abroad economic activities. The dissertation calls the above-mentioned aspects transferring from planned economy to market economy.Transferring from planned economy to free market economy is the substantial change of economic base and resetting of institution. It has been well recognized that the key step to success is the reconstruction of effective institution which will determine the sustainable development of economy.As a norm of economic activities, the economic law is an important component of resetting of institution. It plays a significant role in stipulating the power of state and promoting the marketing economy. As a matter of fact, it is the sign of planned economy and the prerequisite of the legalization of planned economy. The importance of economic law for the transferring countries is as follows:Firstly, the economic law must both entitle the relevant power to state to guarantee the effective management, and dominate the power of state by law to prevent the state's overdue intervention of market. In modern market economy, the recourses are allocated according to market system, at the same time, the objective defect of market need state's correcting. Therefore, the economic law must both guarantee the state's macro-regulation and effective cooperation, and guarantee the economic individual's right, that means the economic law is both the law of state's intervention of market and the law of freedom of economic individuals.Secondly, the purpose of economic law is to safeguard the social public interest. It emphasizes the state's intervention of economic life for the sake of public well-being and try to abolish the negative influence of laissez-faire economy and extreme individualism orextreme nationalism. Social security is the policy and measure the state formulates in order to keep the basic living condition of citizen. Social security law is an important part of marketing economic system. It can help to set the social politics and economic order at rest. Fourthly, the problem of sustainable development. Sustainable development representsa new kind of view of development which can rectify the shortcoming of traditional modelof development. The transferring countries should take the whole situation of population, circumstance and recourses into account and plan accordingly.Fifthly, the problem of economic globalization. Nowadays, the international community seeks stable institution to keep the speed of development. The establishment and development of WTO is the consequence of this trend.
