"Promoting nationality depends on education, Promoting education depends on teachers". During 1949 to 2000, Chinese teacher in primary and middle school contingents keep booming, and elementary education is on the hopeful way of promoting. Focusing on this changing course of development and insisting on the guidance of historical materialism and method theory, the thesis attempts to make use of the method of document, analysis & compare, case, and necessary quantitative, to trace, dissect and comment the evolution track, main content, formulation & implement, effect of primary and middle school teachers laws and regulations. Under the grand background of national politics, economic and culture, the thesis explore the inner relationship and interaction mechanism between ruling education by law, ruling teachers by law and education development to be helpful for nowadays Chinese reformation of primary and middle education.During the 51 years of New China, the construction of primary and middle school teachers laws and regulations experiences sprout, depression, stagnate, resuscitation, surmount and curtain of flourish, which from positive to negation and to negation of the negation, the model of rule by man of education management, teacher management is leaving, the model of rule by law is coming. With a calm retrospection, people will deeply realize that national conditions is both an active source and a negative hindrance for the course of Chinese education legality, which should be put on extra attention in research and operation.The laws and regulations on primary and middle school teachers are widely contained. In terms of routine, it includes teacher administration, education and instruction, position, praise & punishment and advanced studies, etc. In terms of staff, it includes headmaster, teacher in charge of a class, general state teacher and min-ban teacher, etc. This content not only reveal the historical outlook of the construction of laws and regulations on primary and middle school teachers, but also provides authoritative legislation foundation and guarantee for various period primary and middle school teachers work. But on the whole, Chinese present laws and regulations on primary and middle school teachers doesn't form overall content and procedure by far, in addition, the force of controlling execute organization and protecting individual's subjective right are not yet enough by far.The formulation of laws and regulations on primary and middle school teachers is becoming scientific, clear and sound in following aspects: the install of legislative body, the division of legislative powers, and the operation of legislative procedure.
