The so-called noumenon of international crime originates from the most general and fundamental questions which include concept, essence, constitution and classification of international crime. Hence, the ontology of international crime is the theoretical research on these fundamental questions of international crime. These questions are of cornerstone's significance and theoretical presupposed role to theory of international crime, even the whole international criminal law, so that they are situated at the core of kernel in the science of international criminal law. (the science of international criminal law takes international crime as its kernel contents of research) Also on account of these, the author sets down"research on presupposed fundamental theory of international crime: a survey from the division of ontology"as the title of article, and doesn't name it"the ontology of international crime". Although the questions of noumenon of international crime are the cornerstone of the science of international criminal law, the researches of Chinese scholars to them are always short of such special and systematical researches. Tracing the causes, they may be as follows.
