| International police cooperation refers to all assistance and cooperation activities carried out by national or regional police authorities with other countries or regions in order to prevent,crack down on and punish international crimes according to national laws or international treaties concluded.International police cooperation originated and developed in modern Europe.From the initial "political security" to the contemporary prevention and fight against terrorism,transnational organized crime and other nontraditional security threats,the development process has always been accompanied by security issues.In order to carry out international police cooperation,the international community has formulated many international conventions and established various global,regional and specialized cooperation institutions to coordinate actions,thus playing an important role in safeguarding global social security.Today,international police cooperation has developed into an international police cooperation system,dominated by Interpol,supplemented by other inter-regional police cooperation organizations or international(regional)organizations that shoulder police functions.Bilateral cooperation coexists with multilateral cooperation,diversified and multi-field cooperation develops together.Compared with early international policing cooperation,contemporary international policing cooperation in political purpose as a starting point,no longer cooperation target range gradually expanded to the law enforcement and judicial business cooperation in various fields,including international police liaison,sharing information,investigation,joint crime case,cross-border hunting,the crime income recovered,joint special operations,etc.In the face of the continuous threats brought by various non-traditional security,how to carry out international police cooperation at a higher level against the background of the complex and changing international situation and the profound adjustment of interests has become an issue for all countries in the world to consider.Through comparative study,the level of international police cooperation in the world is not consistent.The highest level is the police cooperation under the framework of the European Union and the five Nordic countries,which is characterized by mutual recognition of law enforcement and unified arrest.The international police cooperation in other parts of the world is far from reaching the above level.Globalization provided the international policing cooperation motivation and foundation,but relying on the western capitalist economic development and build,the international policing cooperation system has many unfair,unreasonable,driven by multiple factors in western developed countries and even to resist further cooperation with developing countries,the developing countries in cooperation system lack of voice,always at a disadvantage.International policing cooperation as part of the global security governance,also facing the influence of many factors,legal factors is the key factor of the global international policing cooperation towards a higher level,the existing international policing cooperation in the field of international slightly lagging of legislation,countries around the world about the crime of terrorism and transnational cybercrime has not form a unified law consensus,plus countries legal system and the concept of the inherent differences,international criminal jurisdiction conflict problem is still severe,the legal basis for the international law enforcement is still missing,leads to the formation of a worldwide legal vacuum,makes many transnational crime and international crime less than due sanctions in time,which seriously threatens the life,property and safety of people all over the world.In addition,international police cooperation and international politics influence each other.In the21 st century,the trend of world multi-polarization and economic globalization has become more prominent and obvious,and brought opportunities to all countries,especially developing countries.However,the unfair and unreasonable old international political and economic order has not been fundamentally changed.Contrarily,the international situation is not stable,uncertainty factors significantly increased,the traditional security threats and non-traditional security threats are intertwined affects the international environment,the superposition of global crisis,international order to adjust speed,various kinds of interests contradictions,peace and development of hegemonism and power politics,fighting protectionism and unilateralism,fear of attack and virus outbreaks and so on various aspects of the challenge,the political and social suffering from varying degrees of impact,profound adjustment of the international political and economic order.In this process,emerging countries have emerged as a group,becoming a new driving force for global economic development,pushing the center of power in the world to the east,and leading to the strong exclusivity of the established powers,leading to the escalation of confrontational risks in the international system.In this environment,the development of international police cooperation is facing with various intangible obstacles.In 1984,China joined Interpol and then taken an active part in and carried out international police cooperation.Especially since 2012,under the background of the new era of China’s public security organs to vigorously promote the international law enforcement cooperation,give play to the role of high-level visits between lead,continue to strengthen ties with the UN and the exchange,make full use of the Interpol and the Shanghai cooperation organization and other police and security cooperation platform,and explore establishing billow mae law enforcement and security cooperation mechanism as well as the comprehensive law enforcement security center,actively participate in the relevant multilateral cooperation mechanism under the framework of law enforcement cooperation,with the UN,the association of south-east ASEAN,the EU and other international organizations and foreign law enforcement to keep close contact,bilateral and multilateral enforcement cooperation with countries around the world.However,in comparison,there are still some problems in China’s international police cooperation,such as the uneven global layout of international police cooperation,the low level of international cooperation,the unestablished domestic cooperation system,the weak legal basis,and the relevant cooperation mechanism.At the same time,China as an emerging economies,is becoming a global economic development momentum,the international status of change makes the international policing cooperation development environment also changed accordingly,October 28,2020,the U.S.justice department and FBI arrested "fox hunting action" staff in the United States of China,which is a wake-up call for China.As the world’s largest developing country,China has with the United States equivalent overseas interests,but the distribution of the number of foreign police liaison officer and the global can’t effectively meet the security needs of the reality,the international policing cooperation ability is obviously insufficient,and faced with such severe complex international environment,how to develop more efficient and pragmatic international policing cooperation become China needs urgently.So,China should realize that facing the us-led western countries,this will be the future of China’s international police law enforcement cooperation long-term challenge,to break the bureau,in a short period of time to take stock,to continue relying on existing western international policing cooperation system have been established,to maximize the implementation.Long-term analysis,with the enhancement and development of strength,China should no longer be confined to only participate in all kinds of international policing cooperation organization,a cooperation agreement or treaty,but to play a leading role,the key point to and dare to put forward new ideas,create new mechanism,gradual reform existing unfair in the western international policing cooperation system is not reasonable,seeking to build a more fair and just international policing cooperation and mutual respect and consultation system.China has extensive overseas interests,in the face of the international environment,want to continue to conduct good international policing cooperation,need to adhere to the justice and enforcement of the rule of law,promote cooperation,focusing on based on the principles of action,to continue to optimize the international policing cooperation global layout,perfecting the relevant laws and regulations of international policing cooperation,build and perfect the domestic international policing cooperation organization system at all levels,in the development of foreign police liaison system based on additional foreign legal affairs commissioner system,at the same time pay attention to improve the international law enforcement and judicial practical ability of law enforcement personnel construction. |
