Since the beginning of the 1980s, China's social and economic structure has undergone tremendous changes.The most notable feature is the integration of the transition period, there have been and are a series of profound changes. labour is the core issue in the changes of socio-economic structure. After the issue of building, the core of social problems can be attributed to labour rights. Based on this judgement and construction , from view of legal philosophy in reflection"modern labour"and its domination on the labour rights knowledge , there are systematic study of labour rights in the"comprehensive labour"context :concepts, meaning, structure, nature and value of the basic areas of theory in this article . Based on theory on labour rights and current social reality, there are analysis of characteristics and trend on labour rights in the global structure. At same time , there is another analysis on historical ,status and prospects of the China's labour rights in this article.Based on the current social reality ,the purpose of this article is to criticize and reflect labour practice and theoretical issues in the socio-economic structure, and to put forward a basic meaning of labour rights ,and to prove its importance and significance on the development and changes of right. However, the theoretical analysis of labour rights can not shelter the following insights : the statutory right is static and objective right ,the society can not generate employment opportunities through legislation, solve the problems associated with labour. To this end, it is more importantly to construct system of labour rights after "constitutional option". It requested that we should transform ideal factors of labour rights system into efforts from nation and society work together.
