A Study On The Standardization Development Of China's Sports Gambling

Gambling is not only closely related to the nature of man, but also closely related to our daily life. It can be said that gambling psychology exists throughout all aspects of our lives. In some countries, gambling has even become a key development sector. Sports gambling is an important aspect of gambling. It regards competition results of the sports events as the gambling object, with a strong entertainment essence and different kind of psychological experience, so it is very popular among gamblers.Based on sports gambling in China, especially the development of modern sports betting on a comprehensive description, this paper discribes in detail the difficult situation, market structure, behavior and performance of modern sports gambling and summarizes comprehensively sports gambling management system and operational mechanism of foreign countries. Through the study, the main conclusions are as follows:First, gambling co-developed together with human society. In general, the gambling has two origins. The first is the psychological game unpredictable. Obsession with the contingency of human fate and the fear of Heaven has created the root of human nature of risk-taking. In our country, the thought of "harmony between man and nature" is deeply rooted and such fatalism as "submit to providence" and "implacability of fate" is very popular, which made the Chinese people possess such special character that they have the luck speculation and are addicted to gambling. Mental game extends to real life, transfer and possession of property occurs, then the gambling produces. Second, gambling originated from the game. With the game turned from the initial entertainment and pastime into possession of wealth, the game has also been known as the change in property owned carrier, thus resulting in gambling.Second, gambling governance of China has experienced a process of continuous improvement of national legislation and institution. Early in the ancient society, the governance of gambling is relatively simple and is lack of law rules, so the control of gambling is essentially based on the sovereign's ability and preferences. In the middle and later periods, regulations on gambling began gradually improving, and the word of "gambling" is also gradually taking shape. To the Ming Dynasty and early Qing, gambling law has become mature. In contemporary society, Modern society, gambling law gradually improved, the State Administration for the benefit of the public began to participate in the lottery distribution. But in the ancient and contemporary age, the state does not set up special institutions to manage gambling activities. To a modern society, the state has begun to recognize that and use a positive effect from gambling, the law on gambling can be found in criminal law, public security administrative punishment law, judicial interpretations of the Supreme People's Procuratorate and the State Council administrative regulations. The PBC and the Ministry of Finance has become major administrations of gambling activities. The government have also established two lottery issuers, one is China Sports Lottery Administration Center, the other is China Welfare Lottery Distribution Center.Third, in the international gambling market, the two trends of deregulation and the barriers co-exist. Deregulation and the barriers are actually two aspects of one national policy, which maximize the safeguard of national interests. The aim of deregulation is to promote effective competition in the domestic gambling market and improve the competitiveness of domestic gambling market as a whole. Setting the barrier is to prevent foreign gambling companies to enter domestic market, preventing domestic capital outflows. But as a whole, gradually opening up of the gambling market is a big trend, which performs particularly obvious in countries of EU. It deserves special attention of China's gambling industry development. We must accelerate development to cope with the possible opening requirements of international community on China's gambling market after accession to WTO.Fourth, the structure of China's sports gambling market is a duopoly oligopoly one, with the typical characteristics of administrative monopoly, which has a high degree of market concentration, small product differentiation and high barriers of entry (mainly administrative monopoly). Distribution and sales organizations have the characteristics of administrative monopolies, asymmetric competition and profit-driven. Consumers would have the characteristics of pursuing the benefits, younger, high frequency of consumption and heavy speculation, etc. Sports gambling market performance is mainly reflected in economic and social performance, of which social performance is more significant.On this basis, the paper made a targeted policy recommendations of the future development of China's sports gambling industry:to promote gambling market competition; to strengthen gambling market management; to governer lottery distribution and sales organizations corporate-oriented; to promote sports gambling product development; to improve product sales channels; to strengthen market research; to regulate lottery sales agency marketing practices; to reform the gambling market supervision system; to establish problem gambling assistance system; to promote financial system; to promote the development of non-governmental organizations; to establish a market access system; to develop market performance standards; to promote legalization construction; to implement the participation of control, etc.
