Study on institutions of property rights in fundamental education is objective need to bring market validity into full play and to resolve practical problem. Property rights is the basis of market development. With its clear definition, the duty-right-interest relation among government, school and community can be clearly dealt with, and the transaction institution of property rights can be set up, competition and inspiration mechanism can be activated, so that, in the end, the market mechanism can actively work in relative educational field, and the fundamental educational resources in our country can be made fuller use at the same time of incessantly enlarging them. There are four main problems on property rights in fundamental education, which are weak awareness, unclearly defined, confused transaction and illegal lucre. The main content in this thesis is analyzing the problems in institutions of property. rights in fundamental education and means to improving it, building theory on property rights and its institutions in education, including urgently perfecting the institutions of property rights in fundamental education, standardize the action of subject, reducing the cost of transaction and guiding the activities to serve education as its value pursuit.Property rights theory in education is based on Marxism and new-institutional Economics, which respectively decide the macro-orientation and provides micro-theory. Property rights is the rights of property, and although its intuitionistic form is the relation between subject and object, its essential is property right subject (including public and private Educational property rights is a kind of right-duty-interest relations among the educational property rights subjects, which is formed by the subjects in corresponding to the right-duty-interest of the objects. Its subject is the owner of property rights, including all levels of government, management institutions, educational organizations and individuals, while its object includes visible property which is matter conditions and invisible property that is knowledge property, such as school characteristic, experience and brand, without the exception of creditor's rights and debt of the school. Educational property rights has the attributes of exclusiveness and responsibility, limitedness, transaction, decomposition and entireness and behavior. Correspondingly its main functions are definitions, restriction, inspiration and educational resource collocation.Property rights institutions in education are the aggregation of a set of rules, about which the relative subjects own, possess, control and use different types of educational property in educational activities. Educational property rights institutions are decided by social institutions, social development, technique of property rights and the result of playing games. On the assumption of the new economic man, the institutions of educational property rights should be strong restriction and pilot. The reformation direction of educational property rights institutions should be realizing justice and efficiency. Their relation is to supplement each other and unite each other. With the precondition of institution definition and just execution, institution cost should be ensured as little as possible, so that the function of educational property can be fully realized. Collocating educational resource is the main intention of development of Educational institutions of property rights, however, its essential is the re-adjusting of the relation between organizations and persons. Institution is the result and rules of playing games, so the educational property rights institution is gradually perfect among the positive-sum playing games between government, school and community on the behalf of educateeThe two characters of our fundamental educational institutions are that duty is the first and profit is finite. According to ownership and management, public school, private school and mixed school institutions of property rights form our fundamental educational institutions. Our fundamental educational institutions don't develop successfully, because government is the strongest, balanced games doesn't appear. The government-oriented superficial game cannot make institutions develop timely, because it is entered on solving only the important problems, excessively dependent on government and slowly pushing institution reformation. The three game parties should be balanced, changing the function that the government administers education and promoting development of school and community. For institutions development, justice and efficiency is used to analyze property rights institutions of public school, private school and mixed school, research content needs to be changed.The clear definitude of property rights between government and school is the first mission of public school institutions, making public property exclusive and making school independent by clearly delimiting the right, duty and interest between government and schools. Educational property rights relations among governments is administrative, duty isn't clear on educational investment; Delimiting between government and school about property rights is obscure, which should be delimited from both. Since public school depends on government investment to develop, just institutions of property rights is embodied mainly by justice of educational investment. Our educational investment is changing from emphasis on key schools to realizing equilibrium, moving toward justice. Since government plays a predominant role in institution reformation and execution and its will decides the effect of institution action and execution. Restraining government is the urgent mission of public school institutions.Delimiting unjustly and unclearly is the problem of our private school institutions, which makes structure of property rights twist, can't meet the needs of our economy structure and educational development, influence educational investment directly, rise engagement in speculation and difficulties of executing. What's more, supervising isn't enough and subject isn't fit for rules, which hinder development of private education. This thesis suggest to make better relation between public welfare and benefit, provide profit for holder, adjust structure of property rights, and enhance effective of institutions. As provider of institutions, government should develop institutions actively, so that the old and lagging institutions won't hinder growing of private school.Mixed school is between public and private school, mainly including public transformational school and mixed ownership school, which has a close relationship with our public school transformation policy. In order to make relations of property in mixed school smoothly, it needs redelimiting the ownership and profit right of accumulating asset of public school transformation, and making clear the ownership and controlling-right of the new property brought about by mixed ownership school. Mixed school has both favorable and adverse effects, including developing education and doing harm to education justice. Under the conditions that national financial resources rise and more attention is played to education and justice, mixed school will be changed to public school or private school. Both general adoption of the market principle in western countries and our mixed school are to develop education by means of market, from which we should learn.In the reformation of educational property rights institution, the limitedness of its reforming theory makes us pay more attention to develop our theories, while the limitedness of reforming function makes us know more clearly the problems facing us to resolve and stepping out of reformation misunderstanding, and the limitedness of reforming development tells us that it's very necessary for us to clarify the social factors which influence reforming courses so that we can actively carry through social integrity reform. Only in this way, can we make the reformation of educational property rights institution develop best and go out of limit.
