The Research On The Unclear Property Rights Problem Of The Public University In Our Country

At present, there exist a large amount of unclear defined property problems in China' s public high education management. As a result, the high schools either lack of energy or restrictions, and it will lead to the low efficiency, high cost, and unnecessary additional burden distributed to varied subjects. At the same time, it prevents the social capital invest in the education industry as well. Therefore, how we should define the property rights empowerments clearly. It is the key problem for the college system reform promoting on property right system innovation.This paper based on the property rights theory of new institutional economics and Marx property theory and then checked the existence of the public university property. The public university property definition was made clearly, In addition, its standard and meaning were proposed. Moreover, it analyzed and illustrated education property arrangements in terns of the standard. This paper pointed out the performances of the unclear defined property rights, including the single property rights subject and property rights attached to administrative management right. Lack of property rights power, unclear defined property problems and low efficiency in the property rights resources collocation have led to the lack of independence and free academics. Much phenomenon on the rent seeking in education has also caused. With the development of logical inertia and institution environment and the neglect of manpower capital property value in the traditional public university, they caused directly the ambiguity of the public universities' property rights.The reason of the ambiguity of the public universities' property rights is caused by the unclear relationship between the government and the schools. The public universities' property right is made clearly as long as understanding the relationship between the government and the schools. Then, the function of the government is changed. The internal property subject structure distribution is reasonable and the multi-principal agent relationship is perfected. Every property subject power and benefits are unified by reasonable distribution on the power and functions structure in the university' s property. As a result, the manpower capital property system is gradually established in the public university.
