The thesis mainly focuses on the Sino-American intellectual property relationship in a period of transitional Sino-American relationship and the influence of intellectual property factor upon the transitional Sino-American relationship. In the history of international relationships up to now, no bilateral intellectual property relationship is more complicated than that of Sino-America. And no effect of bilateral intellectual property relationship upon the bilateral relationship is more influential than that of Sino-America.The thesis analyses and expounds through two threads. Firstly, it deals with the characteristics of collision and cooperation in the transitional Sino-American relationship. Therefore, the inevitability of Sino-American collision, the possibility of Sino-American cooperation, and the uncertainty of ways of Sino-American cooperation are all revealed. Secondly, it discusses the origin and development of Sino-American intellectual property relationship, and the historical inevitability of collision and cooperation in the bilateral intellectual property. It analyses that the intellectual property factor is of vital importance in a period of transition in the bilateral relationship. And moreover, it reveals the decisive effect of the intellectual property factor when the transitional bilateral relationship is on the way from collision to the road of certainty of cooperation.Due to the establishment of the model and pattern for the transitional Sino-American relationship, the effect of intellectual property factor upon the Sino-American relationship is directly perceived in the thesis. That is, the transitional Sino-American relationship not only contains collision but also has cooperation. It cooperates through the way of collision and is undoubtedly full of collision. It is a model of collision and cooperation which can be mutually and simultaneously transformed. In this model many factors influence and decide the orientation of the Sino-American relationship. Among them factors of ideology, Taiwan issue, economyand trading, safety, and intellectual property are the major variables which affect the changes of collision-cooperation model. And above all, the factor of intellectual property is of especially vital importance.The thesis puts the questions to be studied in the complicated historical period and important historical transitional years. In this period the Sino-American relationship and their intellectual property relationship face the situations of the ending of the cold war, the disintegration of the two poles, the acceleration of global economy, deepening of China's opening and reforming and its melting into the international world, and the tremendous adjustments of American foreign policies. During this transitional period, American foreign policies towards China are so contradictory that they affect China's utmost national interest - China's modernization cause. At the same time the thesis uncovers the positive side of the factor of the Sino-American intellectual property. It helps to make America adjust its China policy and safeguards China's utmost national interest.The thesis makes international competition ability as the starting point and finishing point of its studies. As the starting point, it analyses that the international competition ability of the U.S.A. is on the decline; and discloses its countermeasures such as making intellectual property protection worldwide in order to readjust foreign trading policy. Therefore, it is quite clear that one of the most vital source motivations of American foreign policies is to enhance international competition ability. Naturally, the question of China's international competition ability becomes the finishing point. It probes into the condition and reason of China's weak international competition ability which has profound influence upon the country's modernization cause. Therefore, to put on the strategy of intellectual property is the fundamental method to improve China's international competition ability.
