On The Protection Of Enterprise Intellectual Property Under The Socialist Market Economic System

As a significant intangible asset of enterprises, intellectual property right has the commercial value. Moreover, it is an important weapon in the competition among the enterprises. And it can participate in the competition of enterprises as an important commercial enterprise weight to ensure the healthy and orderly development of business continuity.Due to the history reasons, intellectual property protection laws are not perfect in our country. And there are still many problems in the enterprise to protect intellectual property. However, in the era of knowledge economy, if companies do not have their own intellectual property rights, they might fall into the kinds of embarrassing situations. Only full play to the important role of IP in the enterprise, and the enterprise to effectively protect intellectual property rights, in order to obtain a dominant position in the fierce competition.This paper first describes the present situation of intellectual property legislation, and then discusses the important role of the intellectual property system in the socialist market economy, and then summed up the status quo of Chinese intellectual property rights in accordance with the protection of intellectual property rights related to the protection of the Germany, American and Japanese experience. Then analyzing the problem from the macro and enterprise level. From the macro level, analyzing two point of view, the one is China’s intellectual problems, and the other is the government did not create the favorable external environment for intellectual property protection. From the enterprise level, mainly analyzing the existing problems of intellectual property protection from four aspects:weak awareness of intellectual property rights, the lack of professional enterprises, enterprises do not pay attention to intellectual property declaration and negative dealing with intellectual property disputes. Finally, exploring the current protection of enterprise intellectual property strategy.
