Study On Administrative Monopoly Problem In China

During the establishing and consummating of the Market Economy System of our country, Administrative Monopoly arise wide attention and deprecation from all circles of the society for its complexity and huge harmfulness. Issues, such as industry monopoly, locality protection, government limiting trading and so on, not only counteract the exertion of the function of market mechanism, infringing the rights and interests of the market principal parts, but also further the corruption in political livings, blocking the course of economy system reforming. Researches on Administrative Monopoly in domestic theoretical field are mainly related to form, cause, aftereffect of the administrative monopoly and anti-administrative monopoly measures. Some of them are reasonable opinions and enlightening theoretic viewpoints, while severe bifurcations lie in various aspects of the administrative monopoly issue. Moreover, cognition of the issue is still deficient. How to clarify the confusion in cognition, roundly study and well grasp administrative monopoly and its developing rules, and eliminate negative influence of administrative monopoly appear to be the urgent problem at present.The article, which including four main parts, conducts generally in-depth analysis and dissertation on issue of China's administrative monopoly, bringing forward a series of principals and practical measures to deal with the administrative monopoly in China's transform period.Chapter â…  and â…¡ introduce relative theories on administrative monopoly and status of the researches on this issue in domestic theoretic field. The article agrees that classic economics, theory of commonality choice, new system economics have senses of guidance and reference in researches on China's administrative monopoly. It agrees that great progress has been made for the researches on administrative monopoly in domestic field while shortages remain. It put forward that administrative monopoly is, the national institutions exert public rights to forbid, limit, baffle, and exclude market competition. Thus, not all administrative monopoly are illegal or reasonless. Someexist necessarily and have rationality. National monopoly is one form of administrative monopoly. Administrative monopoly is related to but also different from national monopoly, economic monopoly, natural monopoly.Chapter III, IV and V mainly review the history of China's administrative monopoly issue, as analyze appearances, features, and aftereffects of China's administrative monopoly during different periods including antiquity, planed economy period, system transform period, etc. Administrative monopoly seems to be catholicity and particularity. As one form used by the state to control and intervene in the market, administrative monopoly exist in all historical periods of China societies. However, changes of situations such as politics, economy and culture made big differences in appearances and features of administrative monopoly in different historical periods. In system transform period, administrative monopoly has features of particularity and complexity in aspects of appearances, causes and economic sequent, as is determined by the factors in this period, including politic and economic systems, status of economy development, legal system construction and mentality and concepts. While analyzing the reasons of the forming of administrative monopoly, the article point out that laggard mentality and concepts can be materialized from the administrative monopoly in economic activities. Low lever of productivity and faultiness market economy compose the economic base of administrative monopoly.Chapter VI and VII analyze administrative monopoly issue in foreign countries and affects to us by the WTO rules. It puts forward that the opinion that administrative monopoly don't exist in developed countries is impractical. As one governmental manner for intervene in economy, administrative monopoly exist in developed countries, too. The difference lies that theirs is based on consummated market economy system and have healthy legal system, and is one means to offset market limitation. Other transform countries meet the similar administrative monopoly issues with China, which shows direct pertinence between administrative monopoly and politic and economic systems. To settle the problem, legal means only is not efficient, while the system basis must be changed. Existing of administrative monopoly in EastAsia makes out that administrative monopoly also relates to status of economy development and tradition of culture. WTO rules have positive effects on regulating China government behaviors and eliminating negative influence of the administrative monopoly. China should strictly observe WTO rules, actively participating in international competitions, and taking moderate protection policy for national economy.The last chapter discusses target, principals and measures of anti-administrative monopoly in our country's transform period. The target is to establish a unite, open domestic market and a fair competitive market order, and to constitute limited, high efficient, service government. The principals include different treatment, economy efficiency, and fair competition. The article stands for that anti-administrative monopoly is not to completely forbid or eliminate administrative monopoly, but take different attitudes and measures for administrative monopoly of various forms and characters. Allowing, limiting, reforming will be the strategy for national monopoly, and limiting monopoly range, dividing governments from enterprises, loosening entry restriction for natural monopoly, eliminating region protection during deepening system reform with the cooperation of legal means, forbidding monopoly behaviors of state-owned enterprises in competitive field during deepening system reform. The article also point out that we must expedite the steps of politic system reform, must cling to constitution reform to restrict government behaviors. We must eliminate the laggard mentality of government standard, absolutism, rank and privilege, and human regulating, thus to form, gain ground and develop democracy, freedom, equality, nomocracy, open and so on which indicate modern democracy and market economy. System reform and legal system construction all have the function of anti-administrative monopoly. Cooperation should be taken so as to achieve the purpose of regulating the behaviors of the government and building a fair competition market order.
