Study On The Trust Mechanism In Rural Land Portection

Agriculture is the foundation of national economy in china, and the land is the core problem of agriculture. In recent years, along with the development of production, the increase in population and the scope extension of human activities, in particular the rise of urbanization and industrialization, rural land destruction and waste is increasingly serious, the non-agriculture trend of agricultural land especially farmland is strengthening. Lacking socialized and diversified mechanism, the existing rural land protection policy is still not perfect. There are many problems in the policy implementation of the governmental rural land protection, the result is not satisfactory. Therefore, it is imperative to strengthen the protection of rural land recourses and to promote sustainable using of it.In allusion to the existed problems in the current land protection and the mechanism defects, and as the standpoint of the project is to protect the rural land resources, the paper proposes a land trust model for the first time in China to aim at building a new socialized and diversified rural land protection mechanism—the land trust protection mechanism, in order to compensate for the existing mechanism defects and deficiencies. The paper makes use of modern economics, management theory and mathematical techniques to investigate the feasibility of establishing a rural land trust protection mechanism, the organizational form and the incentive and restrictive mechanism; it also researches the evaluation and assessment system of protection effect, the regulatory system and the corresponding support system and the measures to match in the protection implementation. The paper is of great realistic significance and the theoretical value in strengthening rural land protection and promoting the construction of socialist new country.The main contents are as follows:(1) First of all, the paper concludes that our existing land management model is a model that protecting farmland is the core of the policy, and makes use of the system theory, the trust-agent theory and the public management theory to analyze the defects and shortcomings of this model from several aspects, then the paper points out that the existing farmland protection for the core policies protection mode needs effective cooperation with socialized and diversified protection mechanism.(2) The paper analyses the feasibility of establishing a rural land trust protection mechanism. The paper analyses the meaning, feature, and the function of land trust protection from the trust basic principles. It makes use of the relevant economic theories to analyze the protection of agricultural land, then we can find that it has a positive externality .The land trust protection is a very effective way to solve the externality, and it is also a useful supplementary to the protection mechanism of current farmland policy. We use mathematical analysis and comparison methods to study the advantages of the economic and social performance of the land trust protection, study land trust protection cases in the foreign countries and conclude their successful experience. We also analyze the domestic legal environment, the foundation in the reality and the constraints to develop rural land trust protection.(3) The operational framework of rural land trust protection. According to the relevant economic theory, the paper advances the choice of the optimal organizational model of related main body of china's rural land trust protection under the condition of regional differences; introduces multi-function intermediary service organization which is guided by the local government, makes their function and business process clearly. According to the definition of trust property, and taking every relevant main rights and obligations as the main contents, the paper establishes the trust lease of the land trust protection. Considering the actual situation of rural land ownership in our country, we put forward the highly operative land trust protection process.(4) The optimal incentive system of land trust protection mechanism. Using the model of finite dynamic game and extended dynamic game, the paper establishes the optimal incentive system of land trust protection mechanism. It analyses the mental risk and the indirect selecting in the mutual protecting of the land and the account for their occurrence, in the same time, establishes the regulatory system of every correlation subject. The land trust protection relates to different behavior decision making of many benefited subjects, this paper sets up the optimal model of decision making of the government ,the farmer and the trustee respectively, and makes out their optimal decision making interval.(5) The supervision in the protecting of agricultural land. The paper analyses the trustee's alienated behavior and the account for its occurrence. It also analyses the behavioral strategy between the supervision institution and the trustee by using dynamic game theory. Using overseas mature evaluation and assessment system of protection in land, the paper establishes an evaluation system for evaluating rural land trust protection effect in china, and sets up evaluation and assessment system of protection in land which based on the fuzzy synthetically evaluation system, it also applies on examples for analysis.(6) The supporting system and policy in the implementation of rural land trust protection. From the aspects of land property rights system, tax policy, farmers living and medical support system and the function of local government, the paper establishes a supporting system and policy in the implementation of rural land trust protection.(7) It is a new thing in China that rural land trust management is for the purpose of protecting land resources. There is no direct evidence for the case of new rural land trust aiming at protecting the land resources as so far in China, but there are many successful cases abrod for reference. The paper finally researches the foreign land trust protection cases, and concludes its successful experience, then we uses Liuyang city as a example to analyze the land trust protection. Through the analysis of the implementation of the Liuyang city in Hunan Province for the purpose to enhance the land economic efficiency, we can find that through the establishment of the land trust service system and improving a series work such as land trust system, not only can we effectively protect the farmland ,we can also availably promote the circulation of the rural land management rights, and greatly improve the local economic development. According to the analysis and evaluation of the Hunan Liuyang land trust management practice, we can enhance the awareness of the possibility and necessity of the land trust management model which is aimed at protecting the land resources.Last, aiming at our country's austere situation of land protection and limitation of the simple rural land protection policy, the paper brings out a socialized and diversified rural land trust protection mechanism. China has the condition to develop land trust protection, and the land trust protection is the useful complementary for the current rural land protection policy.
