As a summary figure of the pre-qin period, Xunzi not only makes a unique contribution to the development of Confucianism based on absorbing the theories of hundreds,but had a profound influence on later age. At the same time, his theory also shows a unique thinking character.The uniqueness of his idea closely related the use of the methodology of”辨-分”.As an important concept,“辨”not only constitutes the prerequisite and foundation of the ritual in Xunzi,but throughout the whole ideological system. This article is from the“辨”of Xunzi, by investigating the use of“辨”of Xunzi to further exploring the methodology of using associated with its legal thought, in order to has a more comprehensive and systematic understanding of Xunzi.As one of the core concepts of Xunzi,“辨”has multiple meanings in Xunzi,and involves various fields, such as epistemology, ethics, these meanings mean distinguishing characterization for it. Through the way of speech,Xunzi shows distinguishes the mischief is for the Dao, it is not only communicating the domain of understanding and the domain of ethical, and making it with the act dimensions.Thurough the way of‘辨”,Xunzi distinguishes between heaven and man, nature and virtue,He points that the differences between heaven and human, nature and character. Through the way, Xunzi breaks many ideas about them. Of course,Xunzi also pays attention to the unification,he denies the twelves just show that he discontents about they holding at the one.Xunzi requests beyonding“辨”,Thus, Xunzi admits the interaction between heaven and man, he criticizes Zhuangzi"Attaches great importance to the day but ignore the man",the premise is that we cant not just to think of heaven-man relationship from“辨”,but need to grasp the two relations from a dynamic perspective in both side. At the same time,Xunzi also affirms the "合" between the nature and man,this shows the practical process of conversing the nature into the virtue. At the same time, Xunzi emphasized the differences between the interest and the virtue,while reflecting the difference tendency from the traditional Confucian concept.Xunzi admits the legitimacy of interest,and points that the possibility of getting rich throuh virtue.Therefore,the’“辨”of Xunzi is to point to“合” ,that means suitable for the requirements of Dao, and the Dao in xunzi often refers to the ritual.For the legitimacy and the rationality of the Dao, through a teleological approach,Xunzi tries to prove that the ritual of the origin, moreover, he further pointes out that the shape of the person’s behavior according to“辨”,also constitutes the metaphysical basis of the ritual. Of course, ritual not only based on‘辨”,but also used for“辨”,ritual establishes the different levels of people in ethics and society, as well as rules different social members’offices However, the“辨”of ritual only has procedural significance, so-called”明分使群”,therefore, its purpose still points to the“合”of ethical and political field. So from the perspective of the logic of the theory, as the logical starting point of the view of Xunzi”辨”constitutes the possibility of the premise of the ritual, the ultimate goal is to achieve political governance. In Xunzi’s view, the achievement of political governance not only needs throughing the ritual,at the same time also needs tha law. So, through the discipline and punishment of the ritual and the law,the different members of the society will achieve ethical,social and political harmony.
