The Theoretical Logic Of The Property And Boundary Constraints

Government reform is the focus and difficulty of the reform cause in the post-reform era. The norms and governance effectiveness of government action are the key to the healthy development of Chinese economic and social development. How to govern the government effectively? The mainstream theory studies are:political science, scholars of the field of law starting from their respective disciplines, mainly about the framework of democracy and the rule of law discusses, and from the economics viewpoint to study the governance is rare.Since the sixties and seventies of the last century, new Institutional Economics has started to focus on the study of the country’s governance. The most compelling property rights theory is also mentioned in it. But the early system of property rights theory is lack of power and interest groups. In this paper, many methods are used to explore government reform from the perspective of the property rights economics, such as multi-disciplinary analysis methods, comparative analysis, game analysis and case analysis method, including knowledge of political science, law, and other relevant disciplines, trying to build a "governmental property rights" theoretical paradigm, adhering to the basic assumptions of the property rights paradigm, and using transaction costs and externalities to analyze government behavior.This study is mainly about how effective governance carried out by the government and to regulate government behavior, trying to establish a "governmental property rights" theoretical paradigm to guide the government reform. The study also focuses on the theoretical logic of its boundary constraints of government property and property rights reform of Chinese government reflection. The paper can be divided into the following sections:the first part is reviews of the literature of the theory of government behavior. On the basis of the Government concept the paper collates and summarizes the existing theory of government behavior. Starting from aspects of research methods, behavioral assumptions, behavior patterns and combination of a newly emerging governance theory, the paper puts forward a new perspective of the theory of government behavior; the second part is the theoretical logic of government property. On the basis of the three concepts of inspection rights, powers, property rights, the paper defines the concept of "governmental property rights".The assumptions of the property rights paradigm is first mentioned, and then the basic categories of transaction costs and externalities are used to examine the logic of the theory of government property, Theoretical background and basic connotation of governmental property rights paradigm were proposed,and analyse the formation mechanism of government property, features and different styles of property rights structure; the third part is about the discussion of government property boundary constraint. It focuses on the main force of government property boundary constraints and analysis of institutional framework and concludes that formal and informal institutions of government property boundary constraints have different functions and only the two institutions play together can better constraining government property; the fourth part is the review of the Government property rights reform during Chinese30years’ reform and opening up and a the validation of the theory of government property paradigm. At last, put forward the general idea of the Chinese government reform of the property boundary constraints of the post-reform era,Innovations in this paper are:first, using modern property rights theory validly interprets the logic of the government’s behavior; Second, enriching theoretical logic of government property and integrating government property rights theory into the theoretical framework of governance; Third analyzing the main constrain government behavior borders and institutional framework; fourth, through the analysis of the practice of the government reform and verification of government property paradigm during Chinese30years of reform and opening up and empirical support, and point out the direction for the Chinese government of the reform of property rights.
