The Contemporary Legal Idea of China is born in our legal practice and also leads the way of legal construction of China. The Contemporary Legal Idea of China is about the faith, conception and thought of socialist legal construction. After the founding of the People’s Republic of China, it is a long winding process for legal construction. From the founding of PRC, the legal construction is a process of newly built and developed, windingly developed and damaged seriously, primary restoration, and fully and fast developed. It has experienced the leaps from legal construction to rule-by-law, which is the modernization of legal construction, making China go on the road of rule-by-law.Correspond to the legal construction of China, legal idea also dealt with the relationship between rule-by-law with democracy, economic construction, and rule-by-virtue, then built socialist idea of the rule by law.In contemporary society, while Chinese society is developing very fast, especially when China is during the period of social transformation. There are lots of challenges, troubles, contradiction and problems. The environment and social foundation of legal construction is still weak. The construction of Chinese legal idea still faces many challenges.The construction of legal idea in transformation period needs the system construction to be base, legal consciousness to be culture, democratic politics to be guarantee, combination of law and morality to be trend. Legal idea should be more abundant, developed and improved in the practice of development of transformation society, then can conduct the healthy and steady development of Chinese legal construction effectively, and promote the achievement of legal state.
