The Study Of The Chinese Economic Law Idea In Economic Transformation Period

At present, China is undergoing a new round of economic transformation. The outlineof the12th Five Year Plan of China put forward that, accelerate the transformation ofeconomic development is the only way to promote scientific development. To ensure thatthe transformation of the mode of economic development achieve substantive progress:Adhere to the strategic adjustment of economic structure, as the main direction ofaccelerate the transformation of economic development; Adhere to building aresource-saving and environment-friendly society as an important focal point toaccelerate the transformation of economic development； Adhere to building aresource-saving and environment-friendly society as an important focal point toaccelerate the transformation of economic development; Adhere to the reform andopening as a powerful driving force to accelerate the transformation of economicdevelopment.In the Economic Transformation Period，scholars of Economic Law’s major concernis what change should be made in government regulation means and legal adjustmentmethods. The idea of Economic Law mainly refers to the inner spirit and universalparadigm，including ontology, epistemology, value theory and methodology. This paperattempts to study the new requirements of the idea of Chinese Economic Law intransformation period，from the value orientation, mode selection, evaluation criteria,explore the adjustment and change which economic legal system and economic law shouldbe made in the current Chinese economic transition period.The theme of this paper is the study of the Chinese Economic Law idea in economictransformation period, mainly includes three aspects:Firstly, combing the specific circumstances of the historical background of this study-economic transformation, clarity the time range of the idea of economic law in whichthis paper discussed. From three angles to sum Chinese economy legal problems ineconomic transformation period, namely experience-oriented, lack of predictability；inadequate attention to the market economy mechanisms；the boundary of governmentregulation ability is not clear. Pointed out that the most important reason of Chinese Lawlegal system behind in the context of economic transformation is: idea backward.Secondly, exploring the logical basis of the idea of Chinese Economic Law, usingdeductive inductive research method, pointed out that should be noted in this paper: thedevelop direction of Chinese economic law idea： Through research in three aspects——the costs of government regulation right, horizontal and vertical configurationand procedural norms, explore the development direction of China economy law in periodof economic transformation.At last, based on the analysis above, put forward the idea of economic law thatshould be promoted in China in the period of economic transformation：livelihood idea、order idea and overall idea. In the Economic Transformation Period, Economic structure,economic growth mode and the pattern of interests are all changing. So it’s time for us topropose new ideas to stabilize the environment for economic development; providedevelopment guidelines to stable social emotional.
