The theory and practice of corruption and anti-corruption show that helming public power is a essential condition of corruption and strengthening power restriction and supervision is the key to anti-corruption. Nowadays, Chinese construction of anti-corruption is facing a serious situation of "co-exist of apparent achievement and big problems, stressing penalty and prevention while more corruption coming into being, people pay more attention to corruption and its impossible elimination recently". Construction of anti-corruption has become to be one of the most important political problems to CPC and PRC. Since the16th CPC National Congress for the first time put forward that,"strengthening the restriction and supervision of power, Establishment of reasonable structure, scientific configuration, the program closely and restricted effective power operating mechanism", the theory of Chinese power restriction and supervision for anti-corruption gradually steps up and the system construction escalates. A preliminary system of Chinese power restriction and supervision for anti-corruption has come into shape. The18th CPC National Congress and the second session of Central Commission for Discipline Inspection of the CPC required that "building a better power restriction and supervision system","tailoring a penalty system, a prevention system and a guarantee system to control power like a tiger in cage". The above requirements are both CPC’s recent anti-corruption construction work plan and the task of Chinese anti-corruption power restriction and supervision. Then, during the more than60years constriction, what experience and lessons shall we learn? What is the current situation? What are the problems and how to solve are key questions for Chinese anti-corruption power restriction and supervision system to answer.The paper’s research object is the civil servant working in CPC organization and public organizations. It researches power restriction mainly from power structure, power allocation and power exercise, and researches power supervision mainly from the right to know, to participate and to express. After analyzing the thoughts, history and current situation of Chinese anti-corruption power restriction and supervision system, this paper tries to draw some historical lessons and experiences and give some practical advice to better Chinese anti-corruption power restriction and supervision system. The paper is made up of introduction, body and epilogue.In introduction, the reason of choosing this subject and its value are specified, the existing research achievements are evaluated, core concept and related category are analyzed, and the research idea, research methods, research content and innovation points are briefly explanined.The body can be divided into5chapters which give a deep research to the thoughts, history, current situation and suggestion respectively.In chapter1, methods of class analysis is fully used to analyze the positive and negative effect of power restriction and supervision of the ancient and the current ideologists, the Marxists, CPC leaders and western thoughts. This paper concludes, from the point of governing and preventing public power dissimilation, building "a interaction system of power restriction and power supervision "is the common ground of the above ideologists. According to the general rule of power restriction, separation is the premise of power restriction, scientific allocation is the bases and standardization is the key.Chapter2researches the history of power restriction and supervision for anti-corruption between the foundations of PRC and the termination of Great Proletarian Cultural Revolution. The paper put forward that, in this period, Chinese anti-corruption power restriction and supervisor system is still on trial stage. Its main achievements are:primary organizations, rules and systems were built, CPC and PRC power contractures were built, some supervision by masses were tried, which together formed the basis for Chinese anti-corruption power restriction and supervision system and provide lessons for that after the Opening and Reform Policy.Chapter3researches the history of power restriction and supervision for anti-corruption after the Opening and Reform Policy. The paper put forwards that, in this period, the main idea of Chinese construction of anti-corruption power restriction and supervisor system is strengthening legislation and institution, and developed quickly after the16th CPC National Congress. Its main achievements are:regulations such as "CPC Inner Supervision Rules(on trial)" were issued, CPC’s anti-corruption power restriction and supervision system got better; laws like" supervision law of the Local People’s Congresses and Local People’s Governments" were issued, the legislative level of the nation’s anti-corruption power restriction and supervision system improved, constructed auditing system, built organs like State Bureau to Prevent Corruption, Anti-corruption Bureau (in People’s Procurator ate),etc, China’s national anti-corruption systems got better, establishing a primary power exercise mechanism between discipline inspection office and auditing system.Chapter4analyzes the achievements, features and experience of Chinese anti-corruption power restriction and supervision system on the basis of conclusions of chapter1, chapter2and chapter3. This paper put forwards, after more than60years construction, China has formed a model of anti-corruption power restriction and supervision with Chinese character, built Chinese power exercise mechanism for anti-corruption and shaped Chinese anti-corruption power restriction and supervision system with Chinese characters. CPC leaded, interim development and level structure are the main features of Chinese anti-corruption power restriction and supervision system. The main experiences we can draw are:CPC’s leading is the premise, power supervision is the guarantee, power restriction is the key, and institution is the base. Chapter5from the target of building clean politics and the serious situation Chinese anti-corruption facing, sets Chinese anti-corruption power restriction and supervision system’s final aim, nearby aim and current aim and makes some suggestions from the level of strategy, tactics and methods. The paper suggests that, as for strategy, power restriction and power supervision should be interacted, power supervision and democracy and legal construction should be interacted, sticking to CPC leading and improving its leading way should be interacted. As for tactics, in order to raise power restriction and supervision construction effect and to anti-corruption effectively, Chinese power restriction and supervision system should keep on strict penalty, set up zero tolerant policy, go on with system change, lessen power-seek-rent chance and stressing institutional construction to control power. As for methods, according to current anti-corruption system building situation and developing trend, Chinese anti-corruption power restriction and supervision system should guided by establishing a right to sound decision-making, implementation, supervision and power restraint and coordination between power structures operating mechanism, impelling the construction of the system of Party congresses with regular annual conferences permanent tenure of office, system combining collective leadership with individual responsibility, straightening out the relationship of within CPC, reinforcing the power restriction and supervision of "top leader" with CPC, trying on power separation mechanism, impelling civil servant property supervising regimentation and building discipline inspection office, auditing office, judicial supervision office interaction mechanism to give more restriction and supervision to civil servant’s decision-making authority and executive authority to prevent corruption.The epilogue though analyzing the room for power restriction in current space, the effect of anti-corruption via power restriction and supervision and evaluating power restriction and supervision’s position and value in Chinese anti-corruption strategy, specifies the difference between Chinese anti-corruption power restriction and supervision and separation of right of executive, legislative and judicial power, briefly summarizes the main idea of Chinese anti-corruption power restriction and supervision construction and show hope and confidence of it.
