Traditional crafts，as an important part of the non-material cultural heritage, creasinglyshows their contradictional awkward situation in the industrialization context. On the onehand, traditional knowledge resources are cut down in the trend of globalization, meanwhile,due to the value identity of cultural diversity, traditional crafts, which are consumpted as akind of heritage resource, play dual roles of both spirit and economy in the contemporarysocial life.The study of intellectual property protection of traditional crafts is just based onthis background.According to jurisprudence, the eassy lays stress on the counterevidence of the objectivereality to the legislation research, focus on the field investigation and case study, andcombined with qualitative analysis, comparative analysis and the method of image analysis,trys to combine the law research with the art research, explore and card the demandrelationship between the traditional handicraft industry and intellectual property legislation, inorder to engage in a pertinency research on the legislation basis, and then provide a referenceto the path selection and improvement of China’s intangible cultural heritage of intellectualproperty laws.From the results of the current study, most legal workers,due to theirprofessional estrangement,barely regard the traditional knowledge as a chaotic entiretywhich is placed into a framework of legal principle discussion with some selected pointsinstesd of being capable of going deep into the internal to understand the problem.As a result,they can hardly do pertinency research on its subjects according to their types, classificationsand gradations, nor to embody the legislation construction, which thereby influences themanipulability of the legislative suggestions. The author tries to analyze not only the culturaldissemination and knowledge security system from the traditional handicraft history andculture aspects,but also the realistic problems combined with the international, regional anddomestic present situation of the legislation and the law enforcement,Especially focus on thecentral conflict in the traditional handicraft industry,. By which to reveal the complexsituation of intellectual property protection in traditional crafts and related industries.Intellectual property protection of traditional crafts is not just a legal issue, what ismore,it is a mechanism the cultural ecology development.
