As the number of Chinese oversea direct investment continues to increase, theenvironmental externality of it is increasingly apparent. And with the concepts ofsustainable development and environmental right gradually accepted by the people,the Chinese oversea direct investment is questioned more and more by the hostcountry people. They ask the Chinese investors to protect the environment of the hostcountry and assume the social responsibilities. At the same time, the theory ofChinese environmental threat is frequently reported by the western medias. Thesesituations make the Chinese oversea investor take great environmental risks. Recently,under the pressure of the public, the host countries take more environmental measuresto regulate the Chinese investors, which make the Chinese investors suffer heavylosses. What’s more, considering that the international investment arbitration tribunalprefer to protect the investors other than the host countries, the host countries now areadding the so called environmental article in the domestic law and the investmenttreaties with other countries. China has began to realized that the Chinese investormust protect the environment of the host countries when they invest in those countries.Because only by this way can the Chinese oversea investment develop sustainablely.As a result, in order to regulate the behavior of the oversea investors, china hasenacted some laws and regulations on the domestic level. However, these laws andregulations are not perfect yet. At last, China’s overseas investors should strengthentheir social responsibility consciousness and initiative to assume the socialresponsibility, which will have a significant meanings on alleviating the tensionrelationship between China’s overseas investors and the host countries.
