Since the1990s, intellectual property, which represents the exclusive right to use innovations commercially rights and the level of technological development, has been becoming enterprise development’s strategic resource and a key element of core competitiveness under the background knowledge-based economic develop rapidly. After the international financial crisis, the major multinational companies of developed countries pay more attention to the intellectual property creation, increasing their R&D investment, strengthening intellectual property layout of core or key technologies in order to resolve the crisis and occupy the opportunities of future economic development and market competition firstly. At the same time, the developed countries multinational companies positively stake their claims with intellectual property and speed up the layout of intellectual property in the Chinese domestic market. Since the1990s,more and more Chinese enterprises expand overseas. Some Chinese enterprises’ ownership of the multinational intellectual property grows rapidly after sever years of development. These Chinese enterprises’increase gradually their ability to use intellectual property to participate competition in the market. However, from the overall point of view, Chinese multinational companies’intellectual property, regardless of number or quality, can not meet the needs of enterprise development. Especially, China’s enterprises, including the excellent Chinese multinational companies, are general lack of the core and key technologies intellectual property rights. Thus Chinese multinational corporations often encounter intellectual property ambush from the developed countries and their multinational companies.This situation also make Chinese multinational corporations be in a passive state.
